i have seen a lot of the prison documentaries from the supermax prisons on cable and in those documentaries nothing like what you say happens with the frequency you describe. i am sure if it did that would be on those shows because that would make for good tv and ratings. i realize those shows are heavily edited, but why would they edit out things like that when conventional wisdom says they usually embellish those situations? my former roommate was a corrections officer at a supermax prison in southern illinois and he read through this thread and he said in his 14 years of experience this type of thing happend a handful of times, but not nearly the frequency you are saying. calling everyone dog shit makes you seem very angry, or that you feel you are better than everyone else. either way, it is not healthy to think like that.

I understand your point about the absolute certainty of a crime before such a punishment, but with your below scenario, you're basically allowing the criminal to set their own punishment and in most instances, it's what they want. Death in such a scenario is not a punishment as they have no care for their or anyone else's life, but life in prison is a punishment no one would want.
which just reinforces the value. I am worth so much that no amount of restitution will make up for it, the only thing that pays that bill is your life.
Now that doesn't mean that I am for it in practice however. because of the possibility of innocent men being convicted in an imperfect justice system, it should only be used on those that confess to a murder and there is irrefutable evidence to support that confession.
that is quite an assumption. there are plenty of people on death row trying as hard as they can to stay alive through appeals. They may have to live in prison, but they still get to live.
But do you agree that the death penalty is a shorter punishment at least? Without it, a person spends the rest of the their life - say, 40 years, in prison. With it, the person spends a shorter time - say, 10 years, in prison. Death comes at the end for both - just one has to stay in prison longer.

i'm not going to go back and re-review all 47 pages of this thread and i am not sure if this has been posted, but here is a page that shows that the murder rate is less in non-death penalty states than in death penalty states...so the deterrence argument seemingly does not hold water...

he would talk about how him and the other co's had to do cell extractions and how some of the co's would beat the guy mercilessly with batons and riot shields and hammerfists and elbows so they did not break their hands. all of these cell extractions had to be videotaped and he said that they were instructed to shake the camera so that it was impossible to tell what was going on. he said he never had a problem with the prisoners because he treated them like humans. the ones that got attacked and had problems with many of the inmates were assholes to them and tended to be a little overzealous with the beatings when doing cell extractions. he told me one time he thought that asshole superguards made all of the other decent guards less safe, and i believed him when he said that. just recently that prison has gotten in some serious trouble and had a few lawsuits filed due to beating prisioners. i looked and my former roommate was not named in the suits, but some people that i met through him were named in the cases.

your question has absolutely no relevence to the death penalty. killing someone to defend yourself and a state murdering someone for revenge are two completely different things. it is not even the same sport, let alone the same league. in the first case you can be found innocent and that the murder would have been justified as self defense. you might not even have to go to court in that case. in my mind capital punishment is not self defense and is therefore not justifiable at any time. but what the hell, i will indulge your question...

Question: Do you think the Nazis believed their actions were acceptable since there was a reason behind them and they were sanctioned by the state?
But do you agree that the death penalty is a shorter punishment at least? Without it, a person spends the rest of the their life - say, 40 years, in prison. With it, the person spends a shorter time - say, 10 years, in prison. Death comes at the end for both - just one has to stay in prison longer.

i could kill someone with my bare hands to protect myself, my friends or my loved ones if i were under attack. but i would much rather defuse the situation if i could. if i did kill an attacker i would have been provoked to act and if it were my only way of getting out of the situation with my own life then i would do it. if it were him or me that was going to die, trust me, it would not be me. that said i do not carry weapons, and i think people that do are weak. weapons give people the confidence to be billy badass and act like thugs because they have a lethal weapon at their disposal if things get out of hand....just my opinion. i think murderers should spend the rest of their existance in prison. it is not my responsibility to lobby or make the case for revenge murder on behalf of the state.
