Absolutely. We have had same-sex marriage here in Massachusetts for more than eleven years now. It has been proven that there are no legitimate arguments against it.

I was thinking the same thing. Crazy that it passed by such a slim margin. Threat to democracy??? Unbelievable.

I haven't read everything, but I would assume he doesn't mean gay marraige is a threat to democracy, but the framework the majority of the SCOTUS used to come to the ruling was.

Really happy with the ruling. Especially happy that the religious nuts got handed a huge loss. I am sick and tired of the religionists using their mythology to determine how the rest of us live. Great news for all of the US. I'm also happy that this court has shown pragmatism. It seems the "conservative" nature of the court is shifting. Even our Chief Justice seems to put legal considerations over politics or religion which is exactly how it should be.

I'd say that it's likely that any time Scalia is writing a dissent, I'm probably happy...and they are entertaining. He quipped, "Who ever thought that intimacy and spirituality [whatever that means] were freedoms? "And if intimacy is, one would think Freedom of Intimacy is abridged rather than expanded by marriage. Ask the nearest hippie."

I would've thought some of these came from The Onion. This decision didn't go his way so apparently the court isn't qualified to decide anything. Or something like that. A temper tantrum of epic proportions which has been recorded forever in a historic document.

Here are some highlights from the curmudgeonly dissent authored by Justice Antonin Scalia, who refers to fortune cookies and hippies to make the point that a small majority of the country's most important court shouldn't be defining liberty for all:
1. "Today’s decree says that my Ruler, and the Ruler of 320 million Americans coast-to-coast, is a majority of the nine lawyers on the Supreme Court... A system of government that makes the People subordinate to a committee of nine unelected lawyers does not deserve to be called a democracy."
2. "The Federal Judiciary is hardly a cross-section of America. Take, for example, this Court, which consists of only nine men and women, all of them successful lawyers who studied at Harvard or Yale Law School. Four of the nine are natives of New York City. Eight of them grew up in east- and west-coast States. Only one hails from the vast expanse in-between. Not a single South-westerner or even, to tell the truth, a genuine Westerner (California does not count)."
3. "And to allow the policy question of same-sex marriage to be considered and resolved by a select, patrician, highly unrepresentative panel of nine is to violate a principle even more fundamental than no taxation without representation: no social transformation without representation."
