    however, everything before that was innocent. and in that case, she made as many decisions and actions as he did. she invited a strange man over to her house on a cold and lonely night and dressed sexy for it. everything in here points to her wanting to fool around and he picked up on it. and there is nothing wrong with that. there's not a woman in here who wouldn't flip the fuck out if i was sending a girl flowers at work and whisking her out for romantic dinners while fucking dozens of girls on the side... becos my actions towards that girl say things even if my words are neutral. they would feel i wa lying to and deceiving said girl on the basis of my actions. same thing here, all signs pointed to "let's get it on." maybe she wanted to but changed her mind, or maybe she never did. but he is perfectly reasonable for thinking that's what she wanted.

    regardless of her motives, the second she said no, he should have stopped. period. that is when he becomes culpable and his actions are wrong. up to then, he is utterly reasonable and behaving like anyone else might, and she is a willing and active participant in things. it is only after she says no that he should or is even capable of realizing his perceptions were wrong. she did not ask for harassment or rape. but she did invite him making a move. once he did and was shot down, he should have packed up and left becos harassment is not what she asked for. but to say there is nothing in this scenario that could possibly be interpreted as maybe she wanted to have a little fun is ridiculous. im sorry it got out of hand, but it was not until the guy disregarded her saying no that he became a bad guy. up until then, he was only reacting to what she was saying and doing.

  • oh yes, I understand completely that I have to wait for the green man when I'm crossing the road. I understand that if I see a snake I probably should not approach it. I know I should wear my seatbelt. Yep, I'm quite common sensical... but don't expect me to take the blame for somebody ELSE being a fuckhead... cos there's no chance in hell that's gonna happen. What I've learned is you can be as safe as you fucking like and it can still happen. You can walk through a dark alley every night and nothing happen. So fuck having to worry about it! In my situation I felt perfectly 100% safe and it never even entered my head that something could happen. He was a friend and I'll be fucked if that means I can't be alone in a room with a guy :o cos that's just ridiculous... and in my case, that's where I 'went wrong'. That's all I did.

    im not guessing that. becos she first tries to say it doesnt matter. that's a dodgy answer and i get the feeling she knows she was dressed up to look attractive. no, it is not a reason for him to harass her after she says no. but it is a reason for him to think maybe she wanted to fool around and make a move. he was not doing anything wrong until she said no and he ignored it.

    look what she was wearing is barred by the federal rules of evidence. it is not a defense. read my post above. that does not mean he should have gotten her to sign a legal consent form before he tried to kiss her. it is utterly reasonable for him to have thought she wanted to fool around. period. none of his behavior was horrible or extraordinary until AFTER she said no. if she had not said no and had gone for it and loved it, you'd all be here congratulating her on seducing him or him on taking the plunge and going for it. the only thing that changes this from being a steamy one night stand to sexual harassment is her saying no. prior to that, yes, all of her decisions make his reaction reasonable. that does not in any way excuse his behavior after she said no. but it does not make the fact that he thought she might want to fool around some sort of sex crime. it does not make him trying to kiss her a sex crime. he was reasonable in reading the situation and thinking "let's give it a shot." then she said no. it should have stopped there. it didnt. and THAT is why he was wrong. not becos he judged her invitation and clothing to be an appeal to fool around. but becos he wouldnt stop after she asked him. making a mistake in perception is NOT a crime. continuing with that course of action after being informed that your perception is mistaken IS a crime.

    I agree with most of what you are saying except for you extreme version of reaching for things that are not there. Unless the OP did some drastic editing, nowhere does it mention anything about kissing, making out, etc. Furthermore, she states that she was wearing old digs she wears around the house. Put aside your speculation about what did/did not happen and we are almost on the same page.
