CNN's Toobin: Mueller's findings on obstruction 'all but an explicit invitation to Congress'

Speaking during a panel discussion, Toobin quoted a finding from a section of special counsel Robert Mueller's report that found that Congress could investigate the president for any "corrupt exercise" of power to be a sign that Mueller's team had opened the door for Congress to pursue obstruction investigations against Trump.

"The conclusion that Congress may apply the obstruction laws to the President's corrupt exercise of the powers of office accords with our constitutional system of checks and balances and the principle that no person is above the law," reads the line from Mueller's report quoted by Toobin.

"There's a sentence here that is all but an explicit invitation for Congress to impeach the president," Toobin argued, referring to line from Mueller's report. "I just think this sentence is enormously important."

I think one of the issues with impeachment is that the left knows impeachment isn't a possibility right now with the Senate.   Impeachment proceedings may just rev up Trump's base and hurt the Dems in the next election.  Pelosi would be made the scapegoat again that Republicans fear for some reason and more Republicans come out to vote against Pelosi even though she isn't running.

why would you try to impeach when the findings are inconclusive, legally speaking?
Team Mueller punted to Congress on the obstruction charge because Team Mueller followed DOJ policy regarding indicting a sitting president. 14 ongoing criminal investigations. This is only going to get worse.

You keep saying this but nothing seems to get worse for the President.   I hope Trump goes to jail but at this rate it will be long after he ends his term as President.

One of the problems with this obstruction and impeachment is that no one expected better from Trump.  The Republicans knew they "hired" a person without a soul so why would they fire a person for acting like they have no soul?    If I get a dog whose breed is known to chew on shoes, I'm not going to get rid of it when it chews on shoes.  I knew that going into it.

the bigger story is that Trump TRIED to obstruct justice, but only didn't because those he asked to carry out his bidding refused to do so, knowing full well it was illegal.
In law, efforts like this are also criminal. Thus, we get charged of attempted murder; we don’t say “the victim didn’t die so it’s all okay”. People get charged with attempting to break the law all the time. It’s not like they should be rewarded for incompetency.
so if mueller believes trump tried to obstruct justice, does that mean he'll be charged after leaving office?
Depends on the prosecutor, but the short answer is yes, he could be, and Mueller laid the groundwork.

Unless you really believe you have the votes in the Senate,  you can't push ahead unfortunately.
That's what House impeachment hearings are for. Determining there's enough evidence to impeach and hold a trial. The trial in the senate is to convince 67 senators to convict. Just need to flip 20, whether by election or preponderence of the evidence. The redactions, particularly those of the intellignece variety, may very well be enough to do it, if it goes that far. 14 ongoing investigations, 12 of which are redacted to protect their integrity. Its going to be ugly
I understand the design but it's not the reality. The house,  through the committees,  can make all the relevant evidence known,  and then the Senate can be whipped.  If you can't whip the votes,  don't start the process.

Get worse? There’s going to be further hill investigory hearings that will likely lead to an impeachment vote. If Team Trump Treason isn’t disgraced like Nixon, he’s at least disgraced as much as or more than Bill Clinton, something that never happened to Obama. I’m not sure his fragile ego couldn’t handle it. He might nuke Nancy’s district.

Sorry, but I don’t equate buying a shoe chewing dog with voters knowingly voting for a candidate that would violate the law during the campaign and while in office and be under 14 separate investigations as a result. The process is slow and deliberate as it should be. Remember Benghazi? Now, that was a witch hunt.

    1. Further hearings would lead to an impeachment vote, which would pass in the House, then proceed to the Senate, where the majority are Republicans who are allegiant to the voters, who are overwhelmingly distrusting of Democrats and trusting of Trump (often to the point of blind acceptance), so it then dies, and Democrats lose what meagre power they have, country gets further divided, the cesspool grows.

    2. There have been an absurd amount of opportunities to bruise Trump's ego. Fuck, all he'd have to do was search his name on Google, or watch any non-Fox channel. I haven't detected any differences in Trump's behaviours two years in, with enough opportunities for him to have felt 'disgraced'. Narcissism of Trump's degree will not allow him to see attacks as anything but 'people who aren't smart like me and just don't understand my very great direction' or 'they just don't see that the ends justify the means'.

    Curious to hear your thoughts.

why would you try to impeach when the findings are inconclusive, legally speaking?

So if there are no impeachment proceedings after learning these findings, what does it say about our rule of law, about what a future president can do and get away with? If nothing is done, this is the level at which the bar is set, isn't it?

Seemed pretty bruised and cowed walking to the chopper today. His base is what you described. The other 9%-12% of indies, blue dog dems and butt hurt Bernie bros? They be disappointed and aren’t likely to vote for Team Trump Treason again in 2020, particularly if the house does its job. Do the American people really want an Administration that lies and deceives and wrecks the institutions of governance to this degree? I don’t think they do. And repubs like Romney and any others that have a soul and a conscience are going to have to make a very difficult choice because someday it might be a dem as POTUS coordinating with Cuba, Venezuela and Iran to throw an election or abuse their power and obstruct justice. Precedent can really suck.
