Remember that one? I hear they’ve moved on to gun control or something about Japan and some crime stats and stuff. But somehow they think they’re safe, something about white male privilege. Like I said, the current administration is aggressively enforcing the rules. I am neither in favor nor against it. You come here without a visa and you might be detained, imprisoned or kicked out. Enter at your own risk. And if you are already here, the same is true. Legally, it does not matter that you have been here 10 years. That is the advice I would give to any client thinking of coming, or being here, without a visa or green card. Be here illegally and bad stuff can happen under the current administration.

    I gave you the answer on paper. My shit is backed up because you have no idea what you are talking about. The answer to your question is yes. It does not take much for ICE or any other law enforcement officer to detain you. ICE probably has even more discretion. Even if you are a US citizen. And yes, enforcement actions have been stepped up under the current administration. You can be detained over a traffic violation or even suspicion of a legal violation. You can be put in jail for keeping a fish that is undersized. Maybe that is a better reference point for someone from Nova Scotia.

    Officers are not judge and jury, that comes later. You get your due process, but it might take awhile and it is not carried out by officers. You should understand that even with a third grade education from another country. And learn how to spell counselor before you engage in a debate that is based on your emotional feelings for humans rather than a practical understanding of how things really work.

    The question, counseller, was not whether they can or do, the question is, is it legal for them to do so? Yes or no? Pretty fucking simple, even with a third grade education.

    You seem to agree that violating constitutional rights is okay because they “can” and “do.” You don’t or haven’t considered whether its actually legal for them to do so and rely on “due process” in two days, weeks, months or years, and have no concern about it because “you’re a white male lawyer.”

    The ICE officers did not present a warrant or officer identification when Pineda was confronted and arrested, according to LCR. The group called the incident a reflection of an “alarming pattern of ICE’s unlawful and inhumane practices in Massachusetts, where federal agents regularly operate without following well-established state and federal law, including their own standards of enforcement.”

    No question they are testing the legal limits, perhaps exceeding them in certain cases. That is not a new concept for law enforcement in the US. Our President is testing legal limits in a myriad of ways, not just immigration. They do not need a warrant to arrest or detain you. Enforcing the immigrations laws is not as cut and dry as you would like it to be. What if being an ICE officer was your job? You have to look at it from both sides.
