@ArkansasBlog tells @ActionNews5 #WM3 defendants unlikely to admit guilt in court tomorrow. More likely they'll plead "no contest"

This sounds like a classic plea agreement.

They'll "admit" to committing a crime -- possibly one less heinous than the ones they were tried on -- and be released. That way, the state saves face and the defendants go free. Fair? No -- but it's the way of the system.

The curious part, to me, is that only 2 of the 3 will be let go. I wonder if one is refusing to agree to one of the state's (likely ridiculous) demands.

Rumor I'm reading now is that all 3 of them are to be released and that they've all already left prison with all of their personal belongings.

Prosecutors and defense attorneys are working out a deal that could result in the release of the West Memphis Three murder defendants as early as Friday, according to legal sources and relatives of victims.

"It's a high probability," said Jackie Byers, 44, wife of John Mark Byers, whose son was one of three 8-year-old boys found nude and hog-tied in 1993 in a watery ditch in West Memphis. "We've been asked not to say anything until after tomorrow."

A source close to the case said the pending deal involves the immediate release of defendants Damien Echols, Jason Baldwin and Jessie Misskelley in return for pleas to lesser charges. All three were convicted of capital murder in 1994. Echols was sentenced to death, while Baldwin and Misskelley are serving life terms

"This deal is going to make everybody happy," said a source who asked not to be identified because of a gag order barring parties to the case from discussing it.

Byers said she, too, was told of the pleas. She said she's glad the three defendants will be released but is upset that they must plea to something she believes they didn't do.

"This means they will never be proven innocent," said Byers, who, like many other followers of the case have been persuaded of the three's innocence by new evidence, including DNA evidence, uncovered in recent years. "All of that (new evidence) might go down the toilet and be lost forever."

Recent DNA testing pointed a finger at a fourth, uncharged individual.

Yeah, the report said all three left maximum security prisons earlier today with all their belongings. It doesn't make sense that only two would be released.

Just been reading about this 'nolo contendre' - plea of no contest.

    http://en.wikipedia.org/wiki/Nolo_contendere

Sounds likely that this is what they will go with - would seem a good deal for them, and is certainly not an admission of guilt, as being reported in some quarters

If they are admitting guilt, then why would they be released? Makes no sense

As a supporter of the wm3 for about 10 years now I really hope this is finally the day! It will be a shame however if they have to plee to anything other than innocence! I hope the new DNA results have pointed directly at someone else thus freeing the three.

Here's another video link...I don't know what to think. Can't wait for tomorrow!!! :D

The state know they aren't guilty, and its a way to 'cta'. And everyone is happy!

I was just thinking this. And why are they admitting guilt if they have been fighting a bad guilty verdict from the first time for 18 years?

Inside source says all three will actually be released. There was supposed to be a gag order regarding the hearing, so this is leaked information which might be slightly incorrect (re: reporting only 2 will be released).

Looks likely that they will submitting a plea of 'no contest' - rather than a guilty plea. This 'nolo contendre' thing is apparently used in plea bargaining where someone does not admit guilt, but accepts the findings of the court or something. I guess it means they are 'not contesting' their guilty charge- and as part of the deal - the judge will rule that they have served adequate time. I'm not a lawyer, but it sounds like a deal has been struck where they will be released.

Info doesn't make sense. If they admit to guilty just to walk, I think they lose all credibility. I hope that's not the case. The video I watched is what one of the victim's fathers is saying he heard. It can't be accurate. There's got to be more to the story.

I think that they are trying to expedite the process by doing the no contest plea. That way, they won't have to wait for the state to appeal for the next two decades in the event that they are acquitted at the new trial.
