    Can we get rid of this antiquated notion that you can pressure someone into having sex. Unless physical force is threatened or used (at which point it is rape) it is mutually agreed to sex. I have to much respect for women to think that they get pressured into sex. They may have sex for different reasons than men, but they're not pressured.

  • you should have used your college education to increase your reading comprehension because i said there is a disparity between the frat boy and the member of a fraternity. this difference has been "debated" her, at length before. i thought it was clearly obvious that i was making that distinction, and in my original post talked about "frat boys" as opposed to members of a fraternity. would you like to have the discussion about that disparity or now? or, is it understood?

    the situations are not parallel in their nature, but they are analagous in their execution...so the explanation for each should follow the same path.

    They are not analogous. Lots of people do stupid stuff while drunk. Froam racist remarks to having sex with someone they normally wouldn't. As much as I wished these things didn't happen there's nothing wrong about it. But it is wrong to make money off it, or to think the consent for you to make money from it can be given by a drunk person.

    man, come on, the fear of being raped is present when a girl is alone with a guy with whom she doesn't want to have sex and he keeps going on and on about it...sometimes, girls succumb to that and let it happen...it doesn't mean that they necessarily wanted it to happen. and there is definite pressure occurring.

    if you want to get into the disparity of the frat boy and the member of a fraternity then we can...frat boys are worthless pieces of garbage...these guys went back to "THE HOUSE" and talked about how awesome they are. i have no sympathy for people like that. i have never said something about someone that i didn't tell that person. in this situation, THEY KNEW EXACTLY WHAT THEY WERE DOING AND WHAT THEY WERE GETTING INTO. it isn't a matter of context.

    Sounds like they agreed to be filmed. Drunkeness doesn't excuse behavior.

    this has been clinically proven false. there has been a psychologically and medically measured "deer in the headlights" reaction in some women when it comes to men trying to force sex on them. they freeze. they fear the consequences of saying no. they think the guy is joking until it is too late. they think he might stop if she doesn't do anything. they simply dont know what to do. it's not so simple. it's like a state of shock. and i know several women who have been through and hearing their stories is gut-wrenching... the guilt, the shame, the second guessing. it's awful. and too many guys in college exploit it.

    whether or not that is ok is not my point. my point is... if such behavior is ok, then why do these guys get off the hook here? how were these guys victims of exploitation and the underage drunk girl given her 6 free shots by a guy at a college party was perfectly capable of consent?

    I think THAT is the key thing in all of this. It's not as though they woke up the next morning after filming and thought, "Oh shit, we acted like assholes, let's see if we can get out of this." No, they've had quite a while to think about it, and it was only after they discovered that most of America thinks they're assholes that they decided to sue.

    see, you're assuming that they were drunk when they signed the release because the lawsuit alleges that they were coerced into signing a release which was misrepresented to them while they were drunk.

    let's go through this. frat boys, filmmakers, actor/comedian. these people have been dealing with extreme situations for quite awhile now. they know what it takes to get around the legalities of embarassing someone in a public forum such as cinema. these frat boys are banking on the evidence of their drunkenness captured on film to sway the finder of fact into adopting their version of the "truth". i do not believe that they would have allowed these people to sign a release while they lacked capacity to do so because they know that they are going to be served for some issue from this film. they, most certainly, covered their backs on this.

    if they were smart, they would have had them sign a release to be filmed and then, later, had them sign a release to be on film after they had decided to include them in the film/dvd release.

    right. intoxication cannot excuse behavior, it only can only mitigate behavior...they could say that they only acted that way because they were drunk and that they aren't really like that...you know, the mel gibson defense.
