SANTA MONICA, Calif. (AP) - Two fraternity boys want to make lawsuit against ``Borat'' over their drunken appearance in the hit movie.

The legal action filed Thursday on their behalf claims they were duped into appearing in the spoof documentary ``Borat: Cultural Learnings of America for Make Benefit Glorious Nation of Kazakhstan,'' in which they made racist and sexist comments on camera.

The young men ``engaged in behavior that they otherwise would not have engaged in,'' the lawsuit says.

``Borat'' follows the adventures of comedian Sacha Baron Cohen's Kazakh journalist charac After a bout of heavy drinking, the plaintiffs signed a release form they were told ``had something to do with reliability issues with being in the RV,'' Taillieu said.

The film ``made plaintiffs the object of ridicule, humiliation, mental anguish and emotional and physical distress, loss of reputation, goodwill and standing in the community,'' the lawsuit said.

It names 20th Century Fox, a unit of News Corp., and three production companies as defendants.

Studio spokesman Gregg Brilliant said the lawsuit ``has no merit.''

The plaintiffs were seeking an injunction to stop the studio from displaying their image and likeness, along with unspecified monetary damages.

``Borat'' debuted as the top movie last weekend with $26.5 million.

    It's my understanding that in order for the filmmakers to use your footage you must sign a release and you must be sober.

    Why is it in today's society everyone wants to be on tv whether it be waving from the crowd at baseball game or committing crimes on "Cops" and letting the whole world see it forever? Or all these shitty reality shows?

    if you want to get into the disparity of the frat boy and the member of a fraternity then we can...frat boys are worthless pieces of garbage...these guys went back to "THE HOUSE" and talked about how awesome they are. i have no sympathy for people like that. i have never said something about someone that i didn't tell that person. in this situation, THEY KNEW EXACTLY WHAT THEY WERE DOING AND WHAT THEY WERE GETTING INTO. it isn't a matter of context.

    suppose you had sex with a drunk girl at your frat party and she sued you for rape becos even though she said yes at the time, she was drunk. do you deserve to go to jail for that? these guys knew what they were doing and signed releases. they shouldnt get money becos they were acting like idiots when they were drunk. otherwise, id be a millionaire.

    legally, a contract is not valid if you are drunk (it goes to the capacity element of those things which always have to be present to form a contract), but these guys weren't drunk, i would be on it, they just didn't read the contract...that's their problem, not sacha cohen's. NEVER SIGN SOMETHING WITHOUT READING IT.

    Thank you for offending me. I'm a member of a fraternity, graduated from college but still a member. To say frat boys are worthless pieces of garbage would be like me saying all hippie liberal douches smell like shit, which we all no is not true. Not ALL of them smell just some of them.

    I am 50/50 with you. To say "I hate frat boys because they are racist, sexist bigots" is frankly as bigoted and generalizing as the racist or the sexist. I was not in a frat, but new people. Most were OK. There were a couple of jerks, but then again, there were some jerks that were not in frats too.

    But these guys got what they deserved. Not because they are "frat boys" but because they signed up for it.

  • Everyone had to expect that it would be the members of fraternities in the pit to defend these guys, its their right. One of the most interesting things about frats and the people that join them is the fact that fraternities breed republicans/conservatives (of course not all but a high percentage) and this thread is proof of that.

    you should have used your college education to increase your reading comprehension because i said there is a disparity between the frat boy and the member of a fraternity. this difference has been "debated" her, at length before. i thought it was clearly obvious that i was making that distinction, and in my original post talked about "frat boys" as opposed to members of a fraternity. would you like to have the discussion about that disparity or now? or, is it understood?

    I wasn't there, and I haven't seen the movie so I don't know what was said or done. But if these guys were duped into signing a movie release form, then that is fucked up - regardless if they are "frat boy pieces of shit" or not.

    well, it's more like comparing apples on a tree, to burnt apples...the things are the same manifestations of behavior...one is just a more extreme form of the behavior. apples and monkeys are nothing alike, while being an idiot and raping a girl are just gradations of behaving in an undesirable way.
