A federal judge dinged John Durham's team for the way they handled a previous court filing.
The judge called prosecutors out for creating a "sideshow" and questioned why they included some details in the filing.
The right wing erupted over the filing last month and falsely claimed it showed that Clinton spied on Trump.
A federal judge dinged prosecutors from the special counsel John Durham's office for creating a "sideshow" with a court filing last month that former President Donald Trump and his allies falsely claimed provided proof that he was illegally spied on by the Clinton campaign.
At the center of the hearing was a conflict-of-interest motion that Durham's office filed in its ongoing case against the former Clinton campaign lawyer Michael Sussmann.
The conflict motion contained almost no new information and highlighted potential conflicts of interest regarding Sussmann's legal representation. But right-wing news outlets and former President Donald Trump took several details in the filing out of context and falsely claimed that it showed the Clinton campaign illegally spied on Donald Trump's 2016 campaign and White House.
Sussmann's legal team subsequently asked to strike those details from the motion, saying the filing was unnecessary because Sussmann had already understood the issues raised in it and waived any potential conflicts. They also accused Durham's team of operating in bad faith and saying the inclusion of those details was "plainly intended to politicize this case, inflame media coverage, and taint the jury pool."
"Until we swear in a jury in this case, you folks have an audience of one, and that's me," the judge said. "Just be mindful of that as we go forward."
Cooper set a later status conference to discuss Sussmann's motion to dismiss Durham's case against him.
"This is a case of extraordinary prosecutorial overreach," Sussmann's lawyers said in their motion for dismissal last month. The filing went on to say that while it has "long been a crime" to make false statements to the government, the law "criminalizes only false statements that are material," meaning statements that directly affect a specific government decision.
"By contrast, false statements about ancillary matters ... are immaterial and cannot give rise to criminal liability," the filing said.
Durham charged Sussmann last year with lying to the FBI during a conversation with then FBI general counsel James Baker in 2016. Durham's indictment said that Sussmann "lied about the capacity in which he was providing" allegations to the FBI about what he claimed was a "secret communications channel" between the Trump Organization and Russia's Alfa Bank.

Among the many GOP efforts to counterprogram the Russia investigation with thinly constructed conspiracy theories, one of the most persistent ones was the so-called unmasking of Michael Flynn.
The idea was that Obama administration officials deliberately targeted Donald Trump associates — and particularly Flynn — by requesting the disclosure of their names in intelligence reports before Trump took office, doing so for political purposes. This fed into long-running allegations of the government “spying” on Trump, who chose Flynn as his national security adviser.
We knew before that this theory had fallen apart. We now know just how spectacularly.
BuzzFeed News late Tuesday revealed a previously top-secret Justice Department report that details the findings of a review ordered by Trump’s attorney general, William P. Barr. The report is a resounding rejection of the conspiracy theories, which were seeded and fertilized throughout Trump’s four years in office by Trump allies and GOP members of Congress.
Essentially, the idea was that the Obama officials might have sought the identity of Flynn in intelligence detailing his December 2016 calls with Russian Ambassador Sergey Kislyak and then leaked details for political purposes. (Flynn would later plead guilty to lying to the FBI about these calls.) And there were valid questions early on about the Obama administration’s use of unmasking, as we wrote in 2017.
But the allegations almost always went beyond the known facts. And now the Justice Department report affirms that the allegations went way beyond what actually happened, too.
In his newly revealed report from September 2020, then-U.S. Attorney John Bash found “no unmasking requests made before Election Day that sought the identity of an apparent associate of the Trump campaign.” He said much the same about the transition period between Election Day 2016 and Trump’s inauguration in January 2017.
“I … examined whether any senior officials had obtained General Flynn’s identity in connection with those communications through an unmasking request made during the transition period,” Bash wrote. “The answer is no.”
“According to the FBI, the Bureau did not disseminate an intelligence report discussing those communications and containing masked [U.S. person identity information] for General Flynn before President Trump’s inauguration,” Bash wrote. “For that reason, the public disclosure of the communications could not have resulted from an unmasking request.”
Bash said the FBI’s version “is consistent with my review of unmasking records, which did not reveal any unmasking request corresponding to a report discussing those communications.”
Bash’s big conclusion: “I have not found evidence that senior U.S. officials unmasked the identities of U.S. persons contained in intelligence reports for political purposes or other inappropriate reasons during the 2016 election period or the ensuing transition period.”
Flynn’s contact with Kislyak was first revealed by Washington Post columnist David Ignatius on Jan. 12, 2017. In a telephone call, the two discussed sanctions during a conversation that might have run afoul of an unenforced federal law called the Logan Act. But speaking to the FBI later, Flynn denied having discussed sanctions. He pleaded guilty to that offense, but Barr’s Justice Department later made the extraordinary decision to try to have the case dismissed, and a lame-duck President Trump pardoned Flynn.

Good news, the bill that just passed this weekend provides funding for 87k new IRS agents, focused on enforcement. You must be thrilled with this Democratic bill!
I'm sure this has given TJ a moment to pause and wonder why there hasn't been any investigations:
Jared Kushner and Ivanka Trump reported between $172 million and $640 million in outside income while working in the White House, according to an analysis of financial disclosures by CREW. It is impossible to tell the exact amount as the income is sometimes reported in broad ranges and cover four months of income before Ivanka Trump officially joined her father’s administration and nearly one month before Jared Kushner joined.
Both Kushner and Trump announced they would not take a salary while working for the government in an attempt to shut down nepotism concerns. While their supporters marked this as a public sacrifice, the massive amount of money they made on the side undercuts that argument, as government salaries would have been less than 1% of their income.
One major factor in their outside profits came from Ivanka Trump’s ownership stake in the Trump Hotel in DC, just blocks from the White House and the locus of influence peddling in the Trump administration. Before business slowed down due to the pandemic, the couple paid a combined 23 visits to the hotel. All told, Ivanka made more than $13 million from the hotel since 2017, dropping from about $4 million a year between 2017 and 2019 to about $1.5 million last year, at least in part due to the pandemic. On top of the drop in revenue, there’s an unexplained drop in the value of her ownership. Having previously claimed it to be worth between $5 million and $25 million, in her final disclosure she listed it as only worth $100,000 to $250,000. She did not report selling any of her ownership share in the hotel.

While after four years it’s still a little hard to tell what, exactly, Ivanka actually did in the White House, her tenure was still marked by repeated scandals revolving around potential conflicts of interest with her businesses. While dealing with foreign governments can raise obvious questions for the children of presidents, getting financial or other benefits from foreign governments while working as a senior staffer in your father’s administration should be an obvious non-starter. But when it comes to Ivanka’s time in the administration, getting foreign trademarks to use after leaving the White House may have been her biggest accomplishment.
Just a month before her father was elected president, Russia renewed two trademarks for Ivanka Trump’s business. This would be the start of a pattern. In 2017, Ivanka’s business won preliminary approval for three Chinese trademarks on the same day that she dined with Chinese President Xi Jinping at Mar-a-Lago. In May 2018, Ivanka’s business was awarded “registration” approval from the Chinese government for five trademark applications, with an additional one getting “first trial approval.” The same week, President Trump announced he would try to save jobs at ZTE, the Chinese telecommunications giant closely tied to the government. A month later, Ivanka’s business got registration approval for three more Chinese trademarks, on the same day her father announced he’d lift sanctions against ZTE.
Ivanka’s business applied for Japanese trademarks the day after her father won the presidency. They were approved around the time of Mike Pence’s visit to Japan where he met with then-Prime Minister Abe. Ivanka also met with Abe, along with her father, about a week after her company applied for the trademarks. She won approval for additional Japanese trademarks in 2017.
In what would become the defining scandal of her time in office, in October 2018 Ivanka’s brand won 16 new trademarks from the Chinese government, including for voting machines. These approvals came about three months after Ivanka announced that her brand was shutting down, and mark the largest number of new Chinese trademarks she received in a single month during the Trump presidency. Six months after the company officially shut down, it received a new trademark to sell the Ivanka brand in Canada. In all, CREW found at least 28 foreign trademarks approved for Ivanka Trump while in the White House.

While most of her work in the White House was fairly nebulous, we do know that she worked on the Trump administration’s implementation of the Opportunity Zones program in 2018, apparently violating conflict of interest law in the process. At the same time that Ivanka was working on Opportunity Zones, Jared owned a significant financial stake in a company called Cadre which offers investment vehicles under the Opportunity Zones program. When Trump and Kushner entered the administration, Kushner’s stake in Cadre was valued between $5 million and $25 million. The value would rise to $25 million to $50 million. Kushner originally failed to disclose his ownership in Cadre. Despite the fact that the top White House ethics official determined at one point that it was “reasonably necessary” for him to divest from Cadre in order to do his job at the White House, he never did.
Jared Kushner and Ivanka Trump should never have been allowed to work in the White House. The Department of Justice reversed decades of precedent to grant President Trump’s wish to have his children work in the White House. While taking on enormous responsibilities that they were unqualified to carry out, and debasing their positions with constant ethics scandals, they likely made hundreds of millions of dollars from questionable sources. All that was waived off by the same nepotism that got them their jobs. Some “sacrifice.”

Tonight, Kyle Cheney reported in Politico that the January 6th committee is handing 20 witness interviews over to the Department of Justice, and yesterday, we learned that the Department of Justice has obtained a warrant to search the phone of John Eastman, who wrote the memo outlining the plan for Vice President Mike Pence to refuse to recognize certified electors for President-elect Joe Biden.
Today, Katelyn Polantz and Evan Perez of CNN reported that a former Department of Justice staffer who worked with Jeffrey Clark, the man whom Trump considered installing as attorney general to further his attempt to overturn the election, has been fully cooperating with the Department of Justice. The staffer is Ken Klukowski, and he has turned his electronic records over to the Justice Department.

Biden’s Justice Department does, in fact, appear to be adhering to the idea that we must all be equal before the law. An exclusive story from CNN today said that Trump’s lawyers are in talks with the Department of Justice about a criminal probe of his efforts to overturn the 2020 election. But, as legal analyst Teri Kanefield points out, the leak of this information is almost certainly coming from the Trump camp, which seems to think an indictment might be coming and wants to get out in front of the story. Kanefield might well be right. Tonight, Fox News Channel host Laura Ingraham, who was in contact with Trump chief of staff Mark Meadows during the January 6 crisis, ran a graphic suggesting the Department of Justice was playing politics rather than defending the law. It said: “If you can’t beat him, indict him.”

The other cover ups were the ones you may remember called the Steele Dossier, illegally spying on Trump, covering for Hillary's email scandal etc. There is a good reason that many of the top brass at the FBI, DOJ either got fired or quickly quit and retired during that time.

Jared Kushner and Ivanka Trump reported between $172 million and $640 million in outside income while working in the White House, according to an analysis of financial disclosures by CREW. It is impossible to tell the exact amount as the income is sometimes reported in broad ranges and cover four months of income before Ivanka Trump officially joined her father’s administration and nearly one month before Jared Kushner joined.
Both Kushner and Trump announced they would not take a salary while working for the government in an attempt to shut down nepotism concerns. While their supporters marked this as a public sacrifice, the massive amount of money they made on the side undercuts that argument, as government salaries would have been less than 1% of their income.
One major factor in their outside profits came from Ivanka Trump’s ownership stake in the Trump Hotel in DC, just blocks from the White House and the locus of influence peddling in the Trump administration. Before business slowed down due to the pandemic, the couple paid a combined 23 visits to the hotel. All told, Ivanka made more than $13 million from the hotel since 2017, dropping from about $4 million a year between 2017 and 2019 to about $1.5 million last year, at least in part due to the pandemic. On top of the drop in revenue, there’s an unexplained drop in the value of her ownership. Having previously claimed it to be worth between $5 million and $25 million, in her final disclosure she listed it as only worth $100,000 to $250,000. She did not report selling any of her ownership share in the hotel.

While after four years it’s still a little hard to tell what, exactly, Ivanka actually did in the White House, her tenure was still marked by repeated scandals revolving around potential conflicts of interest with her businesses. While dealing with foreign governments can raise obvious questions for the children of presidents, getting financial or other benefits from foreign governments while working as a senior staffer in your father’s administration should be an obvious non-starter. But when it comes to Ivanka’s time in the administration, getting foreign trademarks to use after leaving the White House may have been her biggest accomplishment.
Just a month before her father was elected president, Russia renewed two trademarks for Ivanka Trump’s business. This would be the start of a pattern. In 2017, Ivanka’s business won preliminary approval for three Chinese trademarks on the same day that she dined with Chinese President Xi Jinping at Mar-a-Lago. In May 2018, Ivanka’s business was awarded “registration” approval from the Chinese government for five trademark applications, with an additional one getting “first trial approval.” The same week, President Trump announced he would try to save jobs at ZTE, the Chinese telecommunications giant closely tied to the government. A month later, Ivanka’s business got registration approval for three more Chinese trademarks, on the same day her father announced he’d lift sanctions against ZTE.
Ivanka’s business applied for Japanese trademarks the day after her father won the presidency. They were approved around the time of Mike Pence’s visit to Japan where he met with then-Prime Minister Abe. Ivanka also met with Abe, along with her father, about a week after her company applied for the trademarks. She won approval for additional Japanese trademarks in 2017.
In what would become the defining scandal of her time in office, in October 2018 Ivanka’s brand won 16 new trademarks from the Chinese government, including for voting machines. These approvals came about three months after Ivanka announced that her brand was shutting down, and mark the largest number of new Chinese trademarks she received in a single month during the Trump presidency. Six months after the company officially shut down, it received a new trademark to sell the Ivanka brand in Canada. In all, CREW found at least 28 foreign trademarks approved for Ivanka Trump while in the White House.

While most of her work in the White House was fairly nebulous, we do know that she worked on the Trump administration’s implementation of the Opportunity Zones program in 2018, apparently violating conflict of interest law in the process. At the same time that Ivanka was working on Opportunity Zones, Jared owned a significant financial stake in a company called Cadre which offers investment vehicles under the Opportunity Zones program. When Trump and Kushner entered the administration, Kushner’s stake in Cadre was valued between $5 million and $25 million. The value would rise to $25 million to $50 million. Kushner originally failed to disclose his ownership in Cadre. Despite the fact that the top White House ethics official determined at one point that it was “reasonably necessary” for him to divest from Cadre in order to do his job at the White House, he never did.
Jared Kushner and Ivanka Trump should never have been allowed to work in the White House. The Department of Justice reversed decades of precedent to grant President Trump’s wish to have his children work in the White House. While taking on enormous responsibilities that they were unqualified to carry out, and debasing their positions with constant ethics scandals, they likely made hundreds of millions of dollars from questionable sources. All that was waived off by the same nepotism that got them their jobs. Some “sacrifice.”
