it's not just that they "believe in" "traditional marriage" (whatever traditional means), but that they also wield the power to influence politicians through their forms of political activism. they don't even have to refuse to serve LGBT's, hire them, or say horrible things to them at their store to help enact the kind of hatred they proffer. in other words just because a person who identifies as LGBT can by a fucking chicken sandwich with a pickle and/or serve one up doesn't mean that the company isn't actively working against their human rights.

i never said that they didn't have the right to hate gays, dislike gays, not hire gays, etc. (that's their first amendment and private property rights)...however the same exact political process allows for towns that hold opposing viewpoints to say get your shit outta here because we don't want your religious bullshit. What you're talking about is a gov't official restricting private business (or attempting to) due to the opinions expressed by an individual strongly affiliated with said business. Gov't directly influencing private matters due to particular speech. How is that not a 1st Amendment violation?
You also mentioned that Chick-fil-a has the right not to hire gays and I almost posted a link to the EEOC website (I'm going to do it anyway, but with this intro caveat), but it turns out sexual orientation is not one of the protected classes? I'm hardly a gay rights activist, but that surprised me and seems wrong. I thought for sure sexual orientation was explicitly included in the Equal Employment Opportunity Act (which I think is technically just a subset of the 1964 Civil Rights Act). My employer definitely includes sexual orientation as a part of its anti-discrimination policy. Here's the link.
