    i agree. trump has that party by the balls. if it looks like he is going to lose the gop nomination he could run as a third party candidate and pull his 30% away from the gop nominee and severely damage the entire party's prospects in that election.

    all these never trumpers or people who say we have to move on from trump will have to grovel at his feet for support. he is the kind of person that would not give an endorsement simply out of spite.

    At least anecdotally, the response from the GOP is to raise the voting age, repeal the 19th, repeal the 15th and allow only landowners to vote.

    That last one always comes with the phrase that  only people "with skin in the game" should be voting. Yeah, non-landowners that are going to die in prison for spitting on the street (or whatever ridiculous laws the overlords will come up with) don't have skin in the game...

     What it means for Pence to fight his subpoena — politically and legally

    On the afternoon of Jan. 6, 2021, President Donald Trump went after Vice President Mike Pence for refusing to go along with his plot to overturn the 2020 election. He did so even after, according to witnesses, Trump was made aware of the unrest at the Capitol, where some of the rioters chanted, “Hang Mike Pence.” And Trump’s singling him out wound up diminishing whatever chance Pence might ever have of becoming president, by turning the GOP base against him — an effect that registered almost immediately.
    As for those hoping Pence will answer investigators’ questions about all that? Apparently they’ll have to keep waiting: Pence will resist a grand jury subpoena, issued as part of special counsel Jack Smith’s investigation into Trump’s actions vis-a-vis Jan. 6. (Politico’s Kyle Cheney and Josh Gerstein broke the news Tuesday.)
    Pence will reportedly argue that the speech or debate clause of the Constitution makes him immune from testifying. The idea is effectively that Pence was serving a legislative function on Jan. 6 by presiding over the counting of electoral college votes in Congress. The courts have long protected legislators from having to testify or provide information to the executive branch, which includes the Justice Department.
    The decision is a very big one both politically and legally.
    Politically speaking, Pence is hardly the first Trump ally or GOP elected official to resist a subpoena. (Stephen K. Bannon was ultimately sentenced to four months in prison for contempt of Congress, for refusing to cooperate with the House Jan. 6 committee.) Everyone who has faced testifying against Trump knows it comes with the prospect of a barrage of Trump attacks and may alienate the GOP base.

    The chief judge of the federal district court in Washington, D.C., secretly rejected Rep. Scott Perry’s bid to shield more than 2,000 messages relevant to Justice Department investigators probing efforts by Donald Trump to subvert the 2020 election, according to newly unsealed court filings.

    U.S. District Court Chief Judge Beryl Howell unsealed her extraordinary Dec. 28 decision on Friday evening, determining that the “powerful public interest” in seeing the previously secret opinion outweighed the need for continued secrecy.

    Federal prosecutors investigating efforts to overturn the 2020 election have asked witnesses extensive questions about the actions of Rudy Giuliani, a lawyer for former president Donald Trump — including where he got his information about alleged fraud, what he did in the days around Jan. 6, 2021, and what he knew about the actions coming that day, people who have appeared in front of the grand jury say.
    Investigators looking into classified documents taken to Mar-a-Lago, Trump’s Florida home and private club, have sought to force testimony from another Trump lawyer, Evan Corcoran, by saying there is evidence that the former president used the attorney’s legal services in furtherance of a crime.
    And prosecutors have repeatedly sought information on the actions of yet another Trump lawyer, Boris Epshteyn, in connection with both classified documents and Trump’s false electors scheme, three people said. They have quizzed multiple Trump attorneys involved with the documents case, including Christina Bobb, Alina Habba and Jesse Binnall, according to the people familiar with the investigation, who spoke on the condition of anonymity to discuss it.
    The investigative activity highlights one of the ways in which the Trump probes are unusual and complex — turning some of his many current or former attorneys into witnesses or potential investigative targets. A Trump spokesman said the legal strategy was a sign of weakness in the case against the former president.
    The probes are led by special counsel Jack Smith, who was appointed by Attorney General Merrick Garland to insulate the work from political influence. Smith’s pace appears to be quickening as the 2024 presidential election starts to take shape, with Trump once again a candidate and President Biden — Garland’s boss — poised to seek a second term. Trump so far has two declared Republican opponents. Legal experts say that if Smith brings criminal charges against Trump, those charges would likely be pending when the GOP primary debates begin in August.

    In recent weeks, the special counsel has issued a flurry of grand jury subpoenas to high-profile witnesses, including former vice president Mike Pence and former chief of staff Mark Meadows. Smith has also imposed strict deadlines for responses in what may be a push to reach internal charging decisions this spring, people familiar with the investigations said. Some of the requests for information, including of Corcoran, have triggered closed-door legal battles that could significantly complicate that time frame.

    Trump lawyer in court after being forced before grand jury

    WASHINGTON (AP) — A lawyer for Donald Trump was back in court Friday after being ordered to answer questions before a grand jury investigating the possible mishandling of classified documents at the former president's Florida estate.

    M. Evan Corcoran entered federal court in the District of Columbia early Friday morning, one week after a federal judge ruled in favor of the Justice Department in forcing Corcoran to answer additional questions before a grand jury that has been hearing testimony for months. He did not make any comments as he arrived at the building, and left several hours later without saying anything.

    The interest by prosecutors in Corcoran's testimony reinforces the legal dangers confronting Trump, making clear the department's continued focus on whether the ex-president or any of his representatives obstructed government efforts to recover hundreds of classified documents taken from the White House to Mar-a-Lago at the end of his term. A search warrant affidavit released last August showed that investigators were examining potential violations of multiple crimes, including obstruction and the willful retention of national defense information.

    Corcoran is relevant to the investigation because he drafted a letter that was given to the department last June asserting that a "diligent search" for classified documents had been done in response to a subpoena and that all records responsive to that subpoena were being provided. The letter was accompanied by the return of roughly three dozen documents with classified markings.

    But prosecutors have said in court filings that they developed evidence showing that additional classified documents remained at the property. The FBI returned with a search warrant on Aug. 8 and removed roughly 100 additional classified documents, the filings show.

    Attorney-client privilege traditionally shields lawyers from being forced to share details of their conversations with prosecutors. Corcoran invoked that privilege during an earlier appearance before the grand jury when he declined to answer certain questions.

    But prosecutors can get around attorney-client privilege if they can convince a judge that a client was using legal representation in furtherance of a crime, a principle known under the law as the crime-fraud exception.

    The Justice Department made that argument in this case, and secured a sealed order last week from U.S. District Judge Beryl Howell that required Corcoran to appear again before the grand jury to answer additional questions. A federal appeals court this week, also in a sealed order, directed Corcoran to turn over documents to prosecutors.

    Another Trump lawyer, Timothy Parlatore, confirmed in an interview with The Associated Press on Friday that he had voluntarily testified for about six hours or seven hours before the grand jury in December to answer questions about the Trump team's compliance with Justice Department efforts to reclaim the classified documents.     The Mar-a-Lago investigation is being led by a Justice Department special counsel, Jack Smith, who is also examining attempts by Trump and his allies to overturn the results of the 2020 presidential election. Trump faces a separate investigation by the Manhattan district attorney's office — into hush money payments during the 2016 campaign — that appears to be close to wrapping up, as well as an investigation in Atlanta into efforts to reverse Trump's election loss in Georgia.

    WASHINGTON (AP) — A federal judge has ruled that former Vice President Mike Pence will have to testify before a grand jury in the Justice Department's investigation into efforts by former President Donald Trump and his allies to overturn the results of the 2020 election.

    That’s according to two people familiar with the decision, who spoke Tuesday on condition of anonymity because the ruling remains under seal.

    The ruling says Pence will not have to answer questions about his actions on Jan. 6, 2021, when a mob of Trump's supporters stormed the Capitol building as Republican Pence was presiding over a joint session of Congress to certify Democrat Joe Biden's victory. However, he would have to testify about any potential illegal acts committed by the former president, one of the people said.

    Pence and his attorneys had cited constitutional grounds in challenging a grand jury subpoena issued weeks ago. They argued that, because he was serving in his capacity as president of the Senate that day, he was protected from being forced to testify under the Constitution's “speech or debate” clause, which is intended to protect members of Congress from questioning about official legislative acts.

    Trump’s lawyers had also objected to Pence complying, citing executive privilege.

    A Trump spokesman criticized the decision in a statement, accusing the Justice Department of “continuously stepping far outside the standard norms in attempting to destroy the long accepted, long held, constitutionally based standards of attorney-client privilege and executive privilege.”

    “There is no factual or legal basis or substance to any case against President Trump," they added, but did not respond to questions about how Trump's legal team might respond.

    Pence’s team is evaluating whether it will appeal.

    The sealed ruling from U.S. District Judge James “Jeb” Boasberg sets up the unprecedented scenario of a former vice president being compelled to give potentially damaging testimony against the president he once served. And it comes as Pence has been inching closer to announcing a run for the 2024 Republican presidential nomination — a decision that would put him in direct competition with his former boss.

    In addition to the Justice Department probes, Trump is under investigation in Georgia and also in New York, where a grand jury has been hearing testimony about hush money paid to women on Trump’s behalf during the 2016 campaign. That grand jury will not take up the inquiry again this week, two people familiar with the matter said Tuesday, meaning any potential vote on a possible indictment will not happen until next week at the earliest.

    In Washington, Pence was subpoenaed earlier this year to appear before the federal grand jury investigating election interference. In public appearances, he has cast that action as unconstitutional and unprecedented and has said he would pursue the matter as far as the Supreme Court.

    Still, he told ABC’s “This Week” that he might be open to testifying about matters not directly related to his congressional role.

    “I’ve actually never asserted that other matters unrelated to January 6 would otherwise be protected by speech and debate," he told the network. “We’re gonna make that case, but I promise you we’ll respect the decisions of the court."

    Pence has said that Trump endangered his family and everyone else who was at the Capitol that day and history will hold him "accountable.”

    WASHINGTON (AP) — Former Vice President Mike Pence will not appeal a judge's order compelling him to testify in the Justice Department's investigation into efforts to overturn the results of the 2020 election, a spokesman said Wednesday.

    The decision sets the stage for a possible appearance by Pence in the coming weeks before a federal grand jury.

    Pence was subpoenaed months ago by the special counsel investigating attempts by former President Donald Trump and his allies to undo the election results before the riot at the Capitol on Jan. 6, 2021.

    Lawyers for Trump objected to the subpoena on executive privilege grounds, but a federal judge in Washington last week rejected those arguments, forcing Pence to testify. U.S. District Court Judge James Boasberg did give Pence a win by accepting arguments by Pence's lawyers that, for constitutional reasons, he could not be questioned about his actions on Jan. 6.

    Key lawmakers win access to mishandled classified docs

    WASHINGTON (AP) — The Biden administration has begun sharing with a bipartisan group of lawmakers known as the Gang of Eight classified documents found in the possession of former President Donald Trump, President Joe Biden and former Vice President Mike Pence, according to five people familiar with the matter.

    Top lawmakers, including Sen. Mark Warner, D-Va., chairman of the Senate Intelligence Committee, had for months been asking the Justice Department to provide access to the documents — or at least an assessment of what was in them — so that Congress could gauge the potential national security harm.

    That process recently got underway, said the people, who insisted on anonymity to discuss private interactions between the Justice Department and Congress.

    “They’re finally moving. We’ve got a lot more documents to review and, more importantly, to make sure there was mitigation taken," Warner said Wednesday, adding that the documents were being received on a rolling basis. He said that while he was “glad to see progress,” it is “still unacceptable for me that it took this long.”

    A Justice Department special counsel, Jack Smith, is investigating whether Trump mishandled roughly several hundred documents with classified markings that were taken after his term ended to Mar-a-Lago, the former president's Florida estate, and whether he or his representatives sought to obstruct that probe. Another special counsel, Robert Hur, is also investigating the improper retention of documents from Biden's time as vice president that have been located in his Delaware home and his pre-presidential think-tank office. Biden has said he had no knowledge the documents were there.

    A lawyers for Pence also said in January that an apparently small number of papers were inadvertently boxed and transported to his Indiana home at the end of the Trump administration.

    Punchbowl News first reported the development.

    The Biden administration held a classified briefing on the documents earlier this year for members of Congress, but senators accused the executive branch of stonewalling and insisted that they needed for national security reasons to see for themselves what materials the men had been holding.

    The Justice Department had said that it wanted to be cooperative with the lawmakers' demands within the confines of the ongoing investigations.

    Appeals court rejects Trump effort to block Pence testimony

    WASHINGTON (AP) — A federal appeals court on Wednesday night moved former Vice President Mike Pence closer to appearing before a grand jury investigating efforts to undo the results of the 2020 presidential election, rejecting a bid by former President Donald Trump's lawyers to block the testimony.

    It was not immediately clear what day Pence might appear before the grand jury, which for months has been investigating the events preceding the Jan. 6, 2021, insurrection at the U.S. Capitol and efforts by Trump and his allies to subvert the election outcome. But Pence's testimony, coming as he moves closer to entering the 2024 presidential race, would be a milestone moment in the investigation and would likely give prosecutors a key first-person account as they press forward with their inquiry.

    The order from the three-judge panel of the U.S. Circuit Court of Appeals was sealed and none of the parties are mentioned by name in online court records. But the appeal in the sealed case was filed just days after a lower-court judge had directed Pence to testify over objections from the Trump team.

    A lawyer for Pence and a spokesman for Trump did not immediately return emails seeking comment, and a spokesman for the Justice Department special counsel leading the investigation declined to comment.

    Pence was subpoenaed to testify earlier this year, but lawyers for Trump objected, citing executive privilege concerns. A judge in March refused to block Trump’s appearance, though he did side with the former vice president’s constitutional claims that he could not be forced to answer questions about anything related to his role as presiding over the Senate’s certification of votes on Jan. 6.

    “We’ll obey the law, we’ll tell the truth,” Pence said in an interview with CBS News’s “Face the Nation” that aired Sunday. “And the story that I’ve been telling the American people all across the country, the story that I wrote in the pages of my memoir, that’ll be the story I tell in that setting.”

    Smith is separately investigating Trump over the potential mishandling of hundreds of classified documents at his Florida estate, Mar-a-Lago, as well as efforts to obstruct that probe.

    It is not clear when either of the special counsel’s investigations will end or who, if anyone, will be charged.

    Donald Trump’s legal team on Wednesday offered its most detailed public defense yet of the former president’s conduct in the classified documents case now being investigated by a special counsel — arguing that the Justice Department should be ordered to “stand down” on the probe.
    The unusual 10-page letter seeks to pull the legislative branch further into the classified documents case, in which federal prosecutors have convened a grand jury to hear evidence into whether Trump or those close to him mishandled classified documents or obstructed government efforts to retrieve them. The grand jury has been hearing testimony from dozens of witnesses in recent months, including Trump’s own lawyer Evan Corcoran.
    The letter is notable in two ways — first, as a detailed argument for the case to be dropped, a request lodged not with the investigators but with elected officials. Second, it focuses mostly on Trump’s alleged conduct before — not after — a May subpoena demanded he return classified documents kept after his presidency. Trump’s post-subpoena conduct is a key focus of the investigation, according to people familiar with the matter, who spoke on the condition of anonymity to describe an ongoing case.
    The Trump team also argues that White House practices for handling classified information, across multiple administrations, differ so much from how other parts of the government handle national secrets that the Mar-a-Lago case should be handled as a civil matter, not a criminal one. The lawyers note that classified documents have also been found at the homes of President Biden and Trump’s former vice president, Mike Pence.

    A judge agreed with that argument, effectively narrowing the scope of his expected testimony.

    The Justice Department special counsel leading the investigation, Jack Smith, has cast a broad net in interviews and has sought the testimony of a long list of former Trump aides, including ex-White House counsel Pat Cipollone and former adviser Stephen Miller.

    Smith is separately investigating Trump over the potential mishandling of hundreds of classified documents at his Palm Beach, Florida estate, Mar-a-Lago, as well as possible efforts to obstruct that probe. On Wednesday, Trump’s lawyers in that investigation called the Department of Justice investigation “severely botched” and “politically infected” and urged the House Intelligence Committee to step in by holding hearings and introducing legislation to correct classified document handling procedures in the White House and to standardize procedures for presidents and vice presidents for when they leave office.

    “DOJ should be ordered to stand down, and the intelligence community should instead conduct an appropriate investigation and provide a full report to this Committee, as well as your counterparts in the Senate,” the lawyers wrote.
