I figured since the death of RBG, with so much attention being cast upon this judicial body, it was time for a thread of its own. I just read an article that two justices, Alito and Thomas, have "lashed out" at the decision that paved the way for legalization of same-sex marriage. Blows my mind that (at least) two justices believe that religious liberty trumps civil liberties.

    yes, but faith should not inform judicial decisions. i'm sure it must be terribly difficult to separate the two, but to me, it's just common sense that civil rights trumps religious rights.

    I've been listening to most of the hearings....not sure why the Dems don't hammer her on her previous statements related to election year appointments.

    I guess there's not all that much to talk about. She'll be confirmed. When (presumably) Biden wins and the Dems take over the Congress, they'll expand the court because they're bitter that they lost an election to a gameshow host and he was able to appoint three justices. 

    One thing that strikes me as strange is the Democrats are going on and on about Obamacare in regards to the Barrett appointment. Why? There's no case that I know of that's calling into question the whether or not Obamacare is constitutional. They're treating this like it's an election campaign ("Our opponent will take away your healthcare!") but I don't think it works like that.

    And yeah the court was expanded like over 150 years ago, but in more (somewhat) recent years, even the democratic party was against it when FDR wanted to expand it. It's such a shame that the court is so partisan and that there "liberal" justices and "conservative" justices. It really shouldn't matter if their job is just to interpret the law.

    Yes we know how the president is elected....that doesn't change the fact that 5 of the justices were placed by a president that did not receive the popular vote. That means something to a lot of us.

    Right....understood.  No one is arguing that.

    The point is that the people should have a hand in who gets placed on the SC.  And in 5 out of 9 cases that didn't happen.
    should. of course. and the popular vote should also be the deciding factor. but it isn't. 

    I hope democrats actually do something when they control the WH and possibly both chambers instead of sitting on their hands and hoping republicans will do the same the next time they are in power.

    Regardless...that you come on here and argue this shit without knowing about that case tells us all we need to know.  
    I'll always laugh at the popular vote argument. It's not a good one. We all know how the president is elected.

    Yes we know how the president is elected....that doesn't change the fact that 5 of the justices were placed by a president that did not receive the popular vote. That means something to a lot of us.
    but why should the popular vote mean squat when it doesn't decide the election? I actually believe trump when he says that their campaign would have been wildly different had it been decided on vote count alone. he may have won it that way had it been the rules. so saying he didn't get the popular vote is completely moot.
