Yes, because the GOP controlled congress would push it through. A Trump victory means a strong GOP showing in the elections, so both House and Senate would likely have increased control. Right now a fillibuster and veto are the only things that protect against it. And if you think those three justices are bad, what will it look like when we have 2-3 more retiring justices?
