    Don't hate me for this...but when I first saw Aaron (big Aaron, not infant) I thought he had Down's Syndrome or something. :eek: I'm awful, I know. :(

    dirtyT, you might be right about not having Aaron testify, just in the courtroom. I'd have to see it again to be sure.

    Maybe she really, just didn't want Aaron apart of it. Maybe she is trying to keep Aaron behind closed doors to the world. Maybe Oceanic told her to keep Aaron as secret as possible, so that the possibilty of someone who knows it really wasn't hers, doesn't see him. Maybe Oceanic is afraid the world might find out, more people lived/are alive....does this make sense or did I make everyone else stupid?

    Jack is always there to bail Kate out. Kate probably wanted to do this on her own. In a case like this - especially with character witnesses, there would be no surprise witnesses so Jack was listed as a possible witness for the defense.

    The fact that Kate got so damaged by the opening remarks of the prosecuting attorney led her counsel to bring Jack as a witness.

    But the fact there was a possibility Jack could testify, plus the fact that Kate didn't want her mom seeing Aaron are why I feel Kate didn't want him in court. Plus the obvious reason, Aaron thinks Kate is his mom. How traumatic would it be for a toddler to see their "mom" in handcuffs?

    I think you just nailed it.

    One, Kate doesn't want her mom to see Aaron and two, Aaron probably thinks Kate is his real mom.

    I don't think that's it at all. I think Kate just hates whatever happened on the island...and hates the lies (they were forced to tell) even more! I think she didn't want Jack to testify is because she didn't want him to lie for her on the stand.

    that was my take on it too. especially when she said to jack she thinks he's actually starting to believe the story (lies).
    also, when she took the plea bargain, saying she just wanted it to be over is more evidence of that, i think. i think she's trying to get as far away from all-things-island as possible.

    I don't know about that. It seems the island gave her something the real world couldn't. She has freedom, as far we know has settled down in one place and now has a son. She seems of all the people who have gotten off the island best off.

    During the finale last year, she told Jack that they were supposed to leave the island and ignored his pleas that they have to go back.

    So whatever lies she's had to tell seems, to have been ultimately worth it in the end which is why Jack and Hurley who have better moral compasses than Kate are trying to get back.

    so why have we not discussed the fact that this trial took place in LA and not wherever the crime took place. usually you hold trials that are not federal crimes in the state it happened.

    so maybe... just maybe.. kate was involved in a crime in california.. and maybe it involved claire.. and maybe thats why she's got the kid now.. maybe oh maybe.

    and i agree.. kate ddint want jack on the stand because she didnt want anymore lies...

    she loves aaron..but i think she got him in a very shady way...and there is no way she is going back to that island

    Good catch. I was also wondering why Jack would have testified before Kate's mother. In criminal cases, the prosecution presents their case first.

    But, I'd rather a couple of court mistakes than for the show to turn into Lost and Order or CSI, The Island. ;)
