    That's what I thought but I wasn't sure. If have worked in HR for years hiring people into safety sensitive positions and nobody ever looked at any of this crap to base hiring decisions on.

    they might look at your facebook to see if you're posting photos of you doing shots off thai hookers. they might look for signs of immaturity.

    Yeah, I've heard about the facebook/myspace thing. I don't know any hiring supervisors that actually look there, but I have heard of it being done.

    And when you pass the bar, then you can tell me what is and what isn't admissible in court.
    If my Dr writes down in her notes that I thought about throwing my child out the window and one day he is missing, that is admissible.
    Sure as shit some bullshit on a public message board can be used.

    exactly. it happens, but it's not commonplace. and even then, they're not going to dreg up some place like that other webpage and deny a job based on that.

    it certainly is not going to be used as the basis for a criminal charge. this is about gossip and ego.

    a principal who is interviewing me isn't going to log onto the Pearl Jam message board to see if I am a good candidate.

    However, I will have extensive background checks done, and if this person(s) doesn't quit this shit, and keeps putting that trash out there.. it could come back to haunt me at some point. Maybe not via pearl jam message pit, but facebook? I mean.. obviously someone is fucked up enough to do this.. when are they not fucked up enough to go too far? I just want it to stop.. Its obviously totally untrue, and its a rumor thats not funny. I don't know how to stop it, without not making myself a target.. I feel like being here is making me a target at this point.

    I have no idea who is doing this. If I did.. I'd speak to them about it. Not this forum.

    I don't want to leave.. but like I said before, how do I stay and stop being a target of this? I'm not comfortable with it, its creepy.. and its just gone too far. Any suggestions?

    actually, it's not. unless the doctor waives the privilege. but the court cannot demand those notes.

    and no, nothing on here would ever be admissible in court. but then again, what do i know? i just spent an entire semester learning the rules of evidence... what is that compared to your gut feeling?

    those are statements made by people involved in litigation. they can be confirmed, substantiated, and cross-examined about them. a drunk driver who said in court he was sorry, and then was confronted with stuff HE posted showing otherwise. a rape victim claiming damages confronted with stuff SHE posted making the whole thing a joke.

    vastly different from some anonymous, untraceable internet person posting a bunch of wild gossip about someone else. you can't be convicted based on unsubstantiated hearsay. if SHE posted on here about banging 15 year olds, that might be one thing. anything you post can be used against you, just like anything you say can. but what other people post about you cannot be used against you. but that's not what happened. these fears are absurd.

    MY DOCTOR'S NOTES HAVE BEEN SUBPOENED BEFORE. NOT MINE BUT ANOTHER CLIENT'S. ANYTHING SHE WRITES DOWN IS ADMISSIBLE. SHE HAS BEEN A DOCTOR FOR OVER 20 YEARS. I WOULD TEND TO BELIEVE HER BEFORE A LAW STUDENT. SORRY.

    in either case, any of these things can be crossed and confronted. you can put the doctor on the stand, and your client can explain the documents. your link proves nothing. random internet posts by strangers cannot be used against you. now, they could track those people down and ask them to testify. but it's not gonna happen. otherwise every criminal case would be really easy. the prosecutor just has to get a bunch of friends to write on the internet that the defendant did it!

    what's your definition of legal document? anything that can be authenticated and testified to can be introduced into court. but you have to have a witness to authenticate it. if the doctor isn't willing to go on the stand and testify to it, they can't introduce it. doctors enjoy some privilege. just as priests do with penitents and lawyers do with clients. in certain circumstances, some of these can be overridden. again, your fellow client needed a better lawyer.

    The witness to authenticate the medical chart of an ER doctor or GP is the PA or the MSA as they are the ones filling out the documents.
    Not sure why you would need a witness to authenticate a shrink's records besides the person whose head is being shrunk. :confused:

    My definition of a legal document would be something admissible in court that has been authenticated by both parties.
    But I could be wrong.
    Tho I know I am not wrong about patient charts being admissible.

    none of this changes the fact that something an anonymous and unsubstantiated person says about you online would never get into court. it cannot be authenticated, it's prejudicial, and there is no chance to cross examine or confront them about their claims.

    I guess what I find confusing is why is that different from finding a bunch of kiddie porn on someone's hard drive? How can you prove that person was the one that downloaded it? Or do they have to admit it?

    because you own the computer, it's in your possession, it's in your house, on your drive, with your fingerprints and information on it. they can check ip addresses, establish who uses the computer, who possessed it at the time it was downloaded. it has probative value. if you have a reason for why it's there or it's not yours, you can get on the stand and tell the jury or judge that. you have a chance to dispute the weight of that evidence.

    but a prosecutor can't go online, read something and say 'wow, look, daydreamer69 says she's a pedophile! good enough for me.' then print the screen, go before a jury and say "see, she's a pedophile. daydreamer69 says so!" she has to have the chance to confront that person and their claims and explore their basis for it. there's no way to tell who said it, why they said, what they meant by it, or why they believe it.
