The crime is the falsifying of business records, not the reimbursement of Michael Cohen. The crime happened in 2016 before the election. Indeed, the underlying act that made this a felony was that the crime was undertaken to influence the election-- the 2016 election. By definition, it cannot be an official act of the president if Trump was not yet president when he committed the crime. Hope Hicks' testimony does not change this. While I am not very optimistic right now, that's clearly not the only way he wins. There are many variables that still exist...and the economy is still an enormous factor.
