Customs and Border Protection has refused to disclose information about a program last year secretly arranging flights for thousands of undocumented immigrants from foreign airports directly to U.S. cities.
It means that while record numbers of migrants were flowing over the southern border last year, the Biden White House was also directly transporting them into the country.
Use of a cell phone app has allowed for the near undetected arrival by air of 320,000 aliens with no legal rights to enter the United States.
Included in details of a Freedom of Information Act (FOIA) lawsuit first reported by Todd Bensman, the Center for Immigration Studies found Biden's CBP approved the latest secretive flights that transported hundreds of thousands of illegal immigrants from foreign countries into at least 43 different American airports from January through December 2023.
The program was part of Biden's expansion of the CBP One app, which kicked off at the start of last year.
Migrants were able, under Biden's expansion, to apply for asylum using the app from their home countries.
But the Center for Immigration Studies (CIS) notes that the transportation of these migrants directly to the U.S. is one of the lesser known uses of the app.
Aliens who cannot legally enter the U.S. use CBP One to apply for travel authorization and temporary humanitarian release from those airports.
Under this parole release, migrants are able to remain in the U.S. for two years without obtaining legal status and meanwhile are eligible for work authorization.
The administration first said it would not reveal which airports the undocumented aliens were transported, citing a 'law enforcement exception' in the refusal to hand over information.
But new information from CIS lawsuit reveals the locations were not disclosed due to fear 'bad actors' would inflict harm on public safety or the information would create law enforcement vulnerabilities.
CBP lawyers wrote that revealing the airports would 'reveal information about the relative number of individuals arriving, and thus resources expended at particular airports.'
That would in turn reveal 'operational vulnerabilities that could be exploited by bad actors altering their patterns of conduct, adopting new methods of operation, and taking other countermeasures.'
They added this could 'thereby undermin[e] CBP's law enforcement efforts to secure the United States borders.'
But Republicans insist the southern border is not secure, and are demanding Biden implement more strict protocols between the U.S. and Mexican border.
CIS says the secretive flights are 'legally dubious' and claim since CBP will not disclose the locations for fear of 'grave' consequences, it is likely not a program that should continue.
Lawyers also did not disclose the locations of foreign airport departures, making it unclear where these migrants are coming from.
But those eligible for the CBP One applications are citizens from Cuba, Haiti, Venezuela, Nicaragua, El Salvador, Guatemala, Honduras, Colombia and Ecuador.

Sen. Joni Ernst, R-Iowa, attempted to force a floor vote Wednesday on a law that would require illegal immigrants who commit violent crimes be detained by Immigration and Customs Enforcement (ICE), in the hope of preventing avoidable attacks and resulting deaths.
The Iowa Republican's unanimous consent request was thwarted by Majority Whip Dick Durbin, D-Ill., who objected to the request.
Ernst requested unanimous consent from her colleagues in order to advance Sarah's Law to the floor for a vote. During her speech, she pleaded with colleagues to pass her bill, recalling the death of Sarah Root and also referencing the recent death of Laken Riley, both allegedly at the hands of illegal immigrants.
The bill would require ICE to take into custody illegal immigrants who are arrested and charged with causing the death or serious injury of another. This was reiterated by Ernst during her speech. "It would merely require ICE to detain, just to detain, otherwise deportable illegal immigrants charged with killing or seriously injuring another person," she said.
Durbin claimed the bill would detain victims of trafficking or domestic abuse who were charged with crimes. According to him, the bill would "deprive immigrants of the due process that everyone is afforded."
The measure's namesake, Sarah Root, was a 21-year-old Iowa woman who was killed by a drunk driver who was also in the country illegally. Ernst noted that the suspect, Edwin Mejia, was able to post bond and ultimately escape facing the court. '
"Citing the Obama administration’s November 2014 memo on immigration enforcement priorities, ICE declined to take custody of Mejia, despite his repeated driving offenses and history of skipping court dates," Ernst explained.
Riley, the 22-year-old University of Georgia nursing student also referenced by the senator, was killed last month. Another illegal immigrant, Jose Ibarra, was arrested and has been charged with several crimes, including malice murder and felony murder, among others.
News of Riley's killing made headlines across the country last month and has prompted congressional Republicans to demand answers. "The reality is Laken's heartbreaking story did not have to happen," Ernst said.
According to the senator, both Root and Riley's deaths are "doomed to be repeated," under the current policies.
The senator pointed to the immigration practice known as "catch and release," during which illegal immigrants seeking entry on the basis of asylum are released during the processing period. "Instead of being detained while he was processed, he was released into our country — never to be heard from again," she said.
While Ibarra may have been prevented from allegedly killing Riley had he been detained upon entry to the country, Sarah's Law would not have stopped the attack, as Ibarra's criminal record doesn't include crimes in which others were killed or injured.

A majority of U.S. voters say they support the Senate's bipartisan border security bill that the chamber failed to pass and was "dead on arrival" in the House, The Wall Street Journal found in a new poll.
The Journal told survey participants that "a bipartisan group of Senators and the White House recently proposed a bill to make it harder for migrants to get asylum in the U.S., to increase the number of border agents, and give the President the power to limit the number of migrants coming into the country if immigration goes above a certain limit."
Participants then were asked, "From what you've heard, would you favor or oppose this proposal?"
A total of 59% of voters, with roughly equal percentages of Republicans and Democrats, say they would support the bipartisan package, the Journal found.
A plurality of voters put more blame on President Joe Biden than on Republicans for developments in border security, with 45% agreeing with the statement that Biden had allowed more illegal immigration by reversing executive orders that former President Donald Trump had put in place, and that Biden had powers to seal the border but failed to use them.
Another 39% agreed with the statement that the GOP killed the Senate bipartisan deal because Trump told them he didn't want to help Democrats pass legislation.
Also, 74% say they support creating a pathway to citizenship for undocumented immigrants who have been in the country for many years and pass a background check.

71% say immigration and border security have moved in the wrong direction during the past year.

Use of a cell phone app has allowed for the near undetected arrival by air of 320,000 aliens with no legal rights to enter the United States.
It comes after a controversy over a 2022 transportation program in which the administration used taxpayers money to move migrants throughout the country on overnight flights.
Included in details of a Freedom of Information Act (FOIA) lawsuit first reported by Todd Bensman, the Center for Immigration Studies found Biden's CBP approved the latest secretive flights that transported hundreds of thousands of illegal immigrants from foreign countries into at least 43 different American airports from January through December 2023.
The program was part of Biden's expansion of the CBP One app, which kicked off at the start of last year.
Migrants were able, under Biden's expansion, to apply for asylum using the app from their home countries.
But the Center for Immigration Studies (CIS) notes that the transportation of these migrants directly to the U.S. is one of the lesser known uses of the app.
Aliens who cannot legally enter the U.S. use CBP One to apply for travel authorization and temporary humanitarian release from those airports.
Under this parole release, migrants are able to remain in the U.S. for two years without obtaining legal status and meanwhile are eligible for work authorization.
The administration first said it would not reveal which airports the undocumented aliens were transported, citing a 'law enforcement exception' in the refusal to hand over information.
But new information from CIS lawsuit reveals the locations were not disclosed due to fear 'bad actors' would inflict harm on public safety or the information would create law enforcement vulnerabilities.
CBP lawyers wrote that revealing the airports would 'reveal information about the relative number of individuals arriving, and thus resources expended at particular airports.'
That would in turn reveal 'operational vulnerabilities that could be exploited by bad actors altering their patterns of conduct, adopting new methods of operation, and taking other countermeasures.'
They added this could 'thereby undermin[e] CBP's law enforcement efforts to secure the United States borders.'
But Republicans insist the southern border is not secure, and are demanding Biden implement more strict protocols between the U.S. and Mexican border.
CIS says the secretive flights are 'legally dubious' and claim since CBP will not disclose the locations for fear of 'grave' consequences, it is likely not a program that should continue.
Lawyers also did not disclose the locations of foreign airport departures, making it unclear where these migrants are coming from.
But those eligible for the CBP One applications are citizens from Cuba, Haiti, Venezuela, Nicaragua, El Salvador, Guatemala, Honduras, Colombia and Ecuador.
The conservative Heritage Foundation maintains a database, dating to 1979, that it says includes a “sampling” of election-fraud cases brought by prosecutors. In that period, about 2 billion votes have been cast in federal elections, according to a calculation for The Fact Checker by the Brennan Center for Justice. A recent search of the Heritage database found 85 cases involving allegations of noncitizen voting from 2002 to 2023. A large percentage of the cases took place in North Carolina, where authorities have been aggressive in targeting noncitizen voting.
In 2022, Georgia announced that it had completed a citizenship review of the state’s voter rolls and discovered that 1,634 people over 25 years had attempted to register to vote even though they were not U.S. citizens. But none had been permitted to register to vote and, thus, had not cast ballots.
Sometimes state efforts to track down noncitizen voting backfire. Texas in 2019 flagged 100,000 voters as possible noncitizens, but at least 25,000 were erroneously flagged because of data mix-ups. Fourteen voters were removed from voting rolls and then had to be reinstated. A federal judge halted the effort, saying it unfairly targeted naturalized citizens, and, eventually, Texas abandoned the effort. “This is a solution looking for a problem,” U.S. District Judge Fred Biery said.

Democrat senator thwarts GOP effort to pass bill detaining illegal immigrants charged with violent crime
Sen. Joni Ernst, R-Iowa, attempted to pass Sarah's Law to require ICE to detain illegal immigrants charged with violent crimes
Sen. Joni Ernst, R-Iowa, attempted to force a floor vote Wednesday on a law that would require illegal immigrants who commit violent crimes be detained by Immigration and Customs Enforcement (ICE), in the hope of preventing avoidable attacks and resulting deaths.
The Iowa Republican's unanimous consent request was thwarted by Majority Whip Dick Durbin, D-Ill., who objected to the request.
Ernst requested unanimous consent from her colleagues in order to advance Sarah's Law to the floor for a vote. During her speech, she pleaded with colleagues to pass her bill, recalling the death of Sarah Root and also referencing the recent death of Laken Riley, both allegedly at the hands of illegal immigrants.
The bill would require ICE to take into custody illegal immigrants who are arrested and charged with causing the death or serious injury of another. This was reiterated by Ernst during her speech. "It would merely require ICE to detain, just to detain, otherwise deportable illegal immigrants charged with killing or seriously injuring another person," she said.
Durbin claimed the bill would detain victims of trafficking or domestic abuse who were charged with crimes. According to him, the bill would "deprive immigrants of the due process that everyone is afforded."
The measure's namesake, Sarah Root, was a 21-year-old Iowa woman who was killed by a drunk driver who was also in the country illegally. Ernst noted that the suspect, Edwin Mejia, was able to post bond and ultimately escape facing the court. '
"Citing the Obama administration’s November 2014 memo on immigration enforcement priorities, ICE declined to take custody of Mejia, despite his repeated driving offenses and history of skipping court dates," Ernst explained.
Riley, the 22-year-old University of Georgia nursing student also referenced by the senator, was killed last month. Another illegal immigrant, Jose Ibarra, was arrested and has been charged with several crimes, including malice murder and felony murder, among others.
News of Riley's killing made headlines across the country last month and has prompted congressional Republicans to demand answers. "The reality is Laken's heartbreaking story did not have to happen," Ernst said.
According to the senator, both Root and Riley's deaths are "doomed to be repeated," under the current policies.
The senator pointed to the immigration practice known as "catch and release," during which illegal immigrants seeking entry on the basis of asylum are released during the processing period. "Instead of being detained while he was processed, he was released into our country — never to be heard from again," she said.
While Ibarra may have been prevented from allegedly killing Riley had he been detained upon entry to the country, Sarah's Law would not have stopped the attack, as Ibarra's criminal record doesn't include crimes in which others were killed or injured.

House passes immigration bill named after slain Georgia student Laken Riley
The House on Thursday passed a bill that would require the detention of any migrant who committed burglary or theft, legislation that House Republicans named after a Georgia student who police say was killed by a man who illegally crossed the border.
The measure — dubbed the Laken Riley Act — cleared the chamber in an 251-170 vote, with 37 Democrats joining all Republicans present in voting “yes.” It was the latest move by GOP lawmakers to put a spotlight on the situation at the southern border, which has emerged as a key issue in the 2024 campaign cycle and a top vulnerability for President Biden heading into the general election.
Republicans have seized on Riley’s death to hammer the Biden administration.
“Innocent Americans from Laken Riley in Georgia to the 14-year-old rape victim of an illegal immigrant in our home state of Louisiana,” Speaker Mike Johnson (R-La.) said on Wednesday, “they’ve all been victimized by those whom the Biden administration has released into our country. He is releasing them into your state.”
Jose Ibarra, a 26-year-old Venezuelan citizen who authorities said had entered the country illegally, was charged with murder in Riley’s death.
The House approved the legislation hours before Biden is set to deliver his State of the Union address, which Republicans have said they hope will call attention to Riley’s death.
Rep. Jim Banks (R-Ind.) penned a letter to the president this week urging him to say the Georgia student’s name during his remarks, and Rep. Mike Collins (R-Ga.) said his guest seat for Thursday’s speech will be empty “in honor of Laken Riley and all Americans who have lost their lives to an illegal alien criminal.” A number of Republicans are bringing immigration-focused guests to the speech to put a spotlight on the salient issue.

CBP, though, did not facilitate the flights, and the program by which the migrants entered the United States is public information, not secretive. The article also omits who is being flown within or to the United States: migrants who are approved and vetted.
Migrants who flew to and within the United States were allowed entry and thoroughly vetted through CBP One — a mobile app that allows users to schedule appointments to claim asylum with border authorities.

WSJ Poll: Majority Back Bipartisan Senate Border Bill

A majority of U.S. voters say they support the Senate's bipartisan border security bill that the chamber failed to pass and was "dead on arrival" in the House, The Wall Street Journal found in a new poll.
The Journal told survey participants that "a bipartisan group of Senators and the White House recently proposed a bill to make it harder for migrants to get asylum in the U.S., to increase the number of border agents, and give the President the power to limit the number of migrants coming into the country if immigration goes above a certain limit."
Participants then were asked, "From what you've heard, would you favor or oppose this proposal?"
A total of 59% of voters, with roughly equal percentages of Republicans and Democrats, say they would support the bipartisan package, the Journal found.
A plurality of voters put more blame on President Joe Biden than on Republicans for developments in border security, with 45% agreeing with the statement that Biden had allowed more illegal immigration by reversing executive orders that former President Donald Trump had put in place, and that Biden had powers to seal the border but failed to use them.
Another 39% agreed with the statement that the GOP killed the Senate bipartisan deal because Trump told them he didn't want to help Democrats pass legislation.
Also, 74% say they support creating a pathway to citizenship for undocumented immigrants who have been in the country for many years and pass a background check.
Other poll findings included:
"What it [the survey] tells us is this is an issue where voters are looking for solutions," said Democrat pollster Michael Bocian, who conducted the survey with Republican Tony Fabrizio, the newspaper reported. "They're not totally dogmatic about what those solutions are, but they want solutions."
The Journal survey, conducted Feb. 21-28, followed Senate Republicans on Feb. 7 defeating a bipartisan effort to bolster border security that had taken months to negotiate.
By a vote of 49-50, the Senate failed to approve a $118 billion bipartisan package that would tighten immigration laws, help Ukraine fight a Russian invasion, and bolster Israel in its war with Hamas.
After the Senate announced the agreement on Feb. 4, House Speaker Mike Johnson, R-La., took to X to say the bill was "worse than expected" and "dead on arrival" in the House.
The Journal poll found that 20% of voters now rank immigration as their top issue, up from 13% in December and above any other topic, including the economy.
