Border Patrol will stop referring migrant parents who cross into the U.S. illegally with children for prosecution, official says
This
story has been updated to clarify how migrant parents will be processed
going forward. An earlier version incorrectly stated the Trump
administration was suspending prosecutions for parents of migrant
children. The senior Customs and Border Protection official quoted below
was describing how the agency’s operations would change to no longer
refer parents of migrant children for prosecution. Decisions whether or
not to prosecute are the purview of the Department of Justice.
The
U.S. Border Patrol will no longer refer migrant parents who cross into
the United States illegally with children to federal courthouses to face
criminal charges, a senior U.S. Customs and Border Protection official
told The Washington Post on Thursday.
The about-face comes just one day after President Trump signed an executive order
ending his administration’s widely denounced practice of separating
parents and children apprehended for illegally crossing the Mexico
border. Trump’s order said the government would maintain a “zero
tolerance” policy toward those who break the law, but the senior U.S.
official, asked to explain how the government would change enforcement
practices, said Border Patrol agents were instructed Wednesday evening
to stop sending parents with children to federal courthouses for
prosecution.
A Justice Department spokesperson denied changes to the zero tolerance policy and said prosecutions would continue.
But
the decision to refer migrants for criminal charges after crossing
illegally rests with the U.S. Border Patrol, and the senior CBP official
said the agency will no longer send parents who arrive with children to
federal courts.
“We’re suspending prosecutions
of adults who are members of family units until ICE (Immigration and
Customs Enforcement) can accelerate resource capability to allow us to
maintain custody,” the official said.
The official spoke on the condition of anonymity to explain how enforcement operations will change to comply with Trump’s order.
A spokeswoman for the Justice Department, Sarah Isgur Flores, said “zero tolerance” remained in effect.
“There
has been no change to the Department’s zero tolerance policy to
prosecute adults who cross our border illegally instead of claiming
asylum at any port of entry at the border,” she said.
Because
ICE lacks the detention capacity to increase the number of families it
holds in detention, the official acknowledged that many migrant parents
and children will likely be released from custody while they await court
hearings.
Top CBP officials did not know what
the executive order would ask them to do until its release Wednesday,
the official said. The decision to cease prosecutions of parents with
children was made by the Department of Homeland Security for logistical
purposes because the official said it would not be “feasible” to bring
children to federal courtrooms while their parents go before a judge.
Adults
who cross illegally will continue to face misdemeanor charges under the
zero tolerance policy implemented six weeks ago, the official said.
Most
adults who enter illegally through the busiest span of the border — the
Rio Grande Valley in South Texas — are sentenced to time served. But
the official said the criminal prosecution of adults would ensure that
lawbreakers face consequences.
“When a consequence is applied, it makes a difference on recidivism and illegal activity at the border,” the official said.
In
recent weeks the number of migrants arrested along the Mexico border
has declined slightly, according to the latest enforcement data. “It’s
nothing we could call a trend,” the official said.
CBP
officials will monitor migration patterns at the border to see if the
policy change leads to an increase in illegal crossings by family
groups, the official said. “We’re going to watch closely and do what we
need to do.”

Sorry, I wasn't specifically able to recall what your initial opinions were because your most recent posts seemed to ignore the fact that something did change from prior administrations and that this is new so to me it seemed that you were downplaying it and thinking this was just faux outrage by the other side. I think that there is a political side to a lot of situations, but in this case, the party in power was the one politicizing it and twisting the reality of how much control they had over the actions being taken. If you actually read what i've posted in the past you would've seen that I've already talked about my feelings towards the issues that are going on with immigration. this has been going on for years it didn't just start with this administration. It has been going on through all the administrations. and like I said before they only let the immigrants into this country when they need them and that's a sad situation. I'm glad he made the change in policy. I do agree there has to be a vetting process to keep criminals, terrorists and traffickers from getting in. I hope that they're making sure all that are being detained are safe from any criminals that may be awaiting the process. It seems when it's getting close to election time, the party in office suddenly starts to change their immigration policies to get the votes for their party like the past administration for example. That doesn't make them a great president or senator or congressman, it just makes them a politician just like all before them. It's wrong to use these people as your political stepping stone. It's election time and the politicians are coming out in force to investigate the issue and "help" that's why all this is being brought up. They were seperating children from parents in the past administration. Once politicians get elected it'll back to the same. Immigrants should be welcome in this country as long as they don't expect a free ride. Come here to work and spend your money here, not to get in and then collect benefits that aren't available to the people here.

WTF? I haven't done that at all. I VERY specifically already replied before saying that before what's happening now was absolutely NOT happening in the past, because in the past what was happening was that in rare cases children with their parents were separated from them because the parents were deemed unfit to be their guardians (i.e. somehow risking the welfare of the children by being with them), or were unaccompanied minors. These things were done to deal with the situation affecting the children, not as a political power play. That is NOTHING like what started happening in April. You ignored me then and continue to ignore it as far as I can tell. And people being deported isn't even the issue. The issue is taking children away from their parents and warehousing/imprisoning them in terrible conditions as a means of deterrent for potential immigrants and as a poker chip for Trump to get his fucking wall. Now again, why do you continue to refuse to acknowledge how what started happening in April is completely different from what was happening before that? I don't understand it. It's like you're practicing willful ignorance. Are you aware that you're doing it? Does it take effort?

You dont see the difference between zero tolerance policy blanketing ALL situations and circumstances resulting in mass detentions equaling 2000 in a few weeks versus a country having to take special action 11 times in a full year? Like the article says, if the family member is deemed dangerous, maybe has a real criminal record or outstanding charge, maybe is abusive and poses a danger to the child, or some other special circumstances, the authorities may have to make difficult decisions and take special action resulting in separation. And this only happened 11 times, I have no problem with that, you may not have a choice in some sitiations.

I could care less if Canada and Switzerland do it or if Obama personally supervised the detention. Separating children from their parents, due to misdemeanor border crossing, where the child is not in danger from his/her parents, is WRONG , period. It doesn't matter who did it or not.

Border Patrol will stop referring migrant parents who cross into the U.S. illegally with children for prosecution, official says
This story has been updated to clarify how migrant parents will be processed going forward. An earlier version incorrectly stated the Trump administration was suspending prosecutions for parents of migrant children. The senior Customs and Border Protection official quoted below was describing how the agency’s operations would change to no longer refer parents of migrant children for prosecution. Decisions whether or not to prosecute are the purview of the Department of Justice.
The U.S. Border Patrol will no longer refer migrant parents who cross into the United States illegally with children to federal courthouses to face criminal charges, a senior U.S. Customs and Border Protection official told The Washington Post on Thursday.
The about-face comes just one day after President Trump signed an executive order ending his administration’s widely denounced practice of separating parents and children apprehended for illegally crossing the Mexico border. Trump’s order said the government would maintain a “zero tolerance” policy toward those who break the law, but the senior U.S. official, asked to explain how the government would change enforcement practices, said Border Patrol agents were instructed Wednesday evening to stop sending parents with children to federal courthouses for prosecution.
A Justice Department spokesperson denied changes to the zero tolerance policy and said prosecutions would continue.
But the decision to refer migrants for criminal charges after crossing illegally rests with the U.S. Border Patrol, and the senior CBP official said the agency will no longer send parents who arrive with children to federal courts.
“We’re suspending prosecutions of adults who are members of family units until ICE (Immigration and Customs Enforcement) can accelerate resource capability to allow us to maintain custody,” the official said.
The official spoke on the condition of anonymity to explain how enforcement operations will change to comply with Trump’s order.
A spokeswoman for the Justice Department, Sarah Isgur Flores, said “zero tolerance” remained in effect.
“There has been no change to the Department’s zero tolerance policy to prosecute adults who cross our border illegally instead of claiming asylum at any port of entry at the border,” she said.
Because ICE lacks the detention capacity to increase the number of families it holds in detention, the official acknowledged that many migrant parents and children will likely be released from custody while they await court hearings.
Top CBP officials did not know what the executive order would ask them to do until its release Wednesday, the official said. The decision to cease prosecutions of parents with children was made by the Department of Homeland Security for logistical purposes because the official said it would not be “feasible” to bring children to federal courtrooms while their parents go before a judge.
Adults who cross illegally will continue to face misdemeanor charges under the zero tolerance policy implemented six weeks ago, the official said.
Most adults who enter illegally through the busiest span of the border — the Rio Grande Valley in South Texas — are sentenced to time served. But the official said the criminal prosecution of adults would ensure that lawbreakers face consequences.
“When a consequence is applied, it makes a difference on recidivism and illegal activity at the border,” the official said.
In recent weeks the number of migrants arrested along the Mexico border has declined slightly, according to the latest enforcement data. “It’s nothing we could call a trend,” the official said.
CBP officials will monitor migration patterns at the border to see if the policy change leads to an increase in illegal crossings by family groups, the official said. “We’re going to watch closely and do what we need to do.”

Anyway, as I stated yesterday, I think the border issue is being blown way out of proportion and I would not be opposed to way less restrictions and even an open border with any of our land locked neighbors. Mind you, I live about as far from Mexico as you can get so I may be full of hot air on this. Honestly, people are going to continue to cross our borders illegally, both criminals and decent people looking for a better life. I look at it this way though, are the criminals of this country, who can wander across any state border they want and live among you, any worse than those that cross the imaginary line we drew on a map and say no you aren't allowed? If the businesses would quit employing those who have not taken the legal steps necessary to become citizens than we should be cracking down there first. We worry so much about "bad" people crossing that we turn away thousands of good people and spend millions (maybe billions?) doing so. Break the cycle.
