For what it's worth-- and the Constitution no longer seems to be relevant, alas-- the Constitution defines treason as "levying War against [the United States], or in adhering to their Enemies, giving them Aid and Comfort." Unless you don't define Russia as an enemy, I'd say there's a slam-dunk case under the second half of the definition.
Well remember, "enemy" requires that Congress declare war, and only Congress under the Constitution.
But... additional statutes were created that expanded the definition. They were used against the Rosenbergs even though we were not at war with the USSR.
