I am not a criminal. I filed my taxes legitimately. I did not claim income earned from the car wash job because I did not receive a 1099 form and I did not earn more than 600 dollars. There was nothing to report. There was no W-2 at the start of the job.

If you're gonna call me a criminal for that, then you might as well call everyone who works there a criminal. It's not our fault. It's the bosses fault for paying us under the table and avoiding taxation altogether. That's illegal.

I did nothing illegal. If I had received a 1099 (which I did not) I would have filed it.

This is hilarious. So because the employer you knew was illegally paying employees under the table didn't make you fill out a W-2 and didn't send you a 1099, you are relieved of any obligation to pay taxes? News flash dude, the other people working there ARE criminals if they didn't pay taxes... just as you are and just as he is.

No. I did not work there for the whole year. Again with the assumptions. I STARTED working there in late November of 08. I was there JUST over two months. I did not realize it was illegal while I was working there. Yes, if there is no W-2 and there is no 1099, and I make less than 600, there is nothing to claim. Let's be honest, NOBODY claims cash. There are millions of people out there. If everyone who ever did that was arrested, jails would be so overcrowded that the overcrowding that exists now would pale in comparison.

As I stated before, I legitimately filed and paid my taxes. I had one other job in 08 that was completely legal that I paid taxes for legitimately. There is nothing to claim for just over TWO months of a job with little to no income earned, no W-2 and no 1099. There is no record or proof whatsoever that I even worked there. Due to the nature of the situation, it is quite literally as if I never worked there. I can't speak for my former co-workers. As for my former boss, he is a criminal.

I believe what others are trying to say is that when an illegal transaction happens, both parties - giving and receiving - are equally culpable. And I think it's also been thrown out there that the mature thing to do would be to take responsibility for your part in this illegal activity.

But it sounds to me - and I'm trying to pay close attention here - like you're saying you didn't commit any illegal activity by taking the money and not claiming it on your taxes because the job lasted less than 3 months and you made less than $600. (I'm no tax expert, so I won't make any claims about the validity of this line of reasoning.) By that logic, given the line of reasoning above about both parties being culpable, it would seem that if you didn't do anything illegal in your transactions with your employer, then he didn't do anything illegal in his transactions with you.

As for the legality of his transactions with the other employees, we don't have enough info to determine whether his transactions with them were illegal (assuming you are right about the parameters of legal under-the-table transactions, which is a whole other question). Maybe none of the other employees worked more than 3 months or made more than $600 either. Hell, if that's where the line is drawn between what's legal and what's not, maybe that's the real reason he fired you - so he wouldn't cross the line into doing something illegal.

at my last company, we had this really annoying woman as our manager and she just didnt know what she was doing. most people couldnt stand her. we would have email threads similar to the one you described....anyway, my one friend intended to forward one of her dumb emails to me and made some inappropriate, yet funny, comment about her weight issues (she was a tad overweight)...however instead of forwarding it to me, he actually hit the "reply" button and sent it to me and her! :shock: this was late in the day after she had gone home. so we're freaking out trying to figure out what we can do. luckily one of the team leaders, who is a good friend of ours, was there and he got in touch with someone in IT (who had already left for the day) and the IT guy was able to log on from home and somehow delete that email so our manager never saw it....phew...this was when our company was relatively young. years later, no IT would ever do that and both of us would probably have lost our jobs immediately. funny story though.

We got a brand new photocopier at work once worth $10,000 or something and on the day we got it the receptionist and I thought we'd try and photocopy a plastic overhead projector transparency -- but didn't realise that the photocopier couldn't copy that particular weight of plastic. We had melted plastic ALL OVER the internal rollers and the more we pulled the more stringy it would get. ABSOLUTELY SHIT OURSELVES!!! Sooo scared we'd fucked it! We ended up getting it out and no one knew.

Just for your own information, though, I think here's what people hear when you say things like those below... and I think it's this attitude they hear that they're trying to warn you against. (Not saying it's the attitude you actually have, just letting you know how it can come across.)

There is nothing to take responsibility for. I don't work there anymore. As I've already said, there is no proof or record whatsoever that I ever worked there.

That is correct, I did not commit any illegal activity. The ONLY WAY I could have POSSIBLY committed illegal activity is if there had been a W-2 or 1099 form to fill out and I simply didn't do it - which is NOT the case.

My former boss DID and DOES commit illegal activity. If you own your own business and are paying employees to work for you, you are required to pay payroll taxes, etc. He does not pay any taxes.

As for your claim that the real reason he fired me was maybe so he wouldn't cross the line into doing something illegal is ridiculous. There are multiple people that have been there for over 10 years and have earned FAR MORE than 600 dollars. They obviously weren't fired before they earned that amount, so that is not the case.

Do a bit of reading up on your state law regarding this, sit back and relax and don't do anything while it's still raw and in a couple of weeks see if you still want to pursue this and figure out how you're going to do that.
