Kel Varnsen wrote:Disturbing the peace and resisting arrest seem like a pretty good reason for the police to use force. The guy wasn't there to ask a question, he was there to create a scene. Plus you have to remember that Kerry is still a senator and his a higher level of security around him than your average person. Besides personally if I was resisting arrest (not that I would be dumb enough to) I would rather take a tazer than a crack or 2 on the head with a baton.
HE WAS ASKING A QUESTION!!!!!!!!!!!!!
When has asking a question become an arrestable offense?

It was the COPS that made this video possible. Not the kid.
We have a lot of dumbasses on this board, too.

not sure I completely get the belly scratch thing...
but ok, a question for those who think the authorities overreacted:
If the kid's time to speak was done. He was asked to stop. Didn't stop. Authorities tried to pull him out, but he resisted.
What should have been done? Let him continue his rant at the expense of everyone else's time, or keep struggling with him (while being careful not to hurt him physically or emotionally)?
If the taser was too violent, should they have just shut the whole event down? or maybe had it moved next door?
I just want to know what the "proper" way to handle this situation is.0 -

dont worry, most of them are all talk, no action.
JamMaster, I am not the one who is incapable of discussion without personal attacks. you are the one who brought my intelligence into the discussion without knowing anything about me. again, I dont think your posts even deserve a response, but I am going against my better judgement here.
in general, we trust our 3 branches to do a job. with this comes responsibility and privilege, and sometimes abuse. thats the system, if you dont like it, you are free to leave or do something about it. they did what they felt was necessary to subdue this person. he was disturbing the peace, and it should not be tolerated. why they didnt take him outside, i dont know and i dont think it mattered. the people on this campus knew his reputation and would have followed him with cameras regardless.
as far as the guy who said that cops dont like a fair fight, this isnt saturday night in a back alley in some podunk town where two people beat the crap out of each other because they dont have anything better to do. they have a job to do, and they did it.-

To quote the CNN story he said "You will take my question because I have been listening to your crap for two hours" After that he yelled more than one question. If you are going to be that hostile and disrespectful to the people around you then you should be asked to leave (disturbing the peace is most definitely an arrestable offense). If you resist that (which according to the report I read he did), than the police have the authority to use force to subdue you. It is not like the police arrested a guy who was going away peacefully, he was resisting. If you are going to resist arrest you should expect those types of consequences.0 -

I agree with this more than anything else I have read on this board. If you want to start some shit with a cop by no means should the cop or cops try to make it a fair fight. Like you said they are doing a job and if you are trying to hurt a cop they should be able to stop as quickly and as efficiently as possible.0 -

He stood at the microphone until they pulled the plug. He wasn't shouting anti-whatever slogans, he wasn't pumping his fist, he wasn't trying to incite a riot. He was asking why he was suddenly being arrested by six goons in uniform.

He continued to monopolize the mic after being asked to stop. A couple of cops stepped up, at that point there is no indication that he was being arrested. Rather than stop and listen to Kerry attempt to answer the questions, he starts pulling away toward the front of the venue. That's when things escalated. That's when he was disturbing the peace."I'll use the magic word - let's just shut the fuck up, please." EV, 04/13/080 -
from the Chicago Municipal Code:
"A person commits disorderly conduct when he knowingly: (a) Does any act in such unreasonable manner as to provoke, make or aid in making a breach of peace; or (b) Does or make any unreasonable or offensive act, utterance, gesture or display which, under the circumstances, creates a clear and present danger of a breach of peace or imminent threat of violence; or (c) Refuses or fails to cease and desist any peaceful conduct or activity likely to produce a breach of peace where there is an imminent threat of violence, and where the police have made all reasonable efforts to protect the otherwise peaceful conduct and activity, and have requested that said conduct and activity be stopped and explained the request if there be time; or (d) Fails to obey a lawful order of dispersal by a person know by him to be a peace officer under circumstances where three or more persons are committing acts of disorderly conduct in the immediate vicinity, which acts are likely to cause substantial harm or serious inconvenience, annoyance or alarm;"
youre telling me he does not fall into this description after he is asked to stop and has to be forced out?-

He wasn't asked to stop before they pulled the plug. He objected to the plug being pulled, but you can see in the video the cops had started to crowd him by the time he had even got that far.
If you've ever watched any kind of political press conference it is not uncommon for a reporter to string a few line of questions together even though the "rule" is almost always to ask just one question. Asking more than one question is not "disturbing the peace." Questioning the authority of the officers to remove him for doing just that is not "disturbing the peace."

If anything, the cops, or whomever gave the order to go after the student... those people should be charged with disurbing the peace.

So the cops planned ahead of time that this was the punk they were gonna nail...?
Why would they ALL suddenly "crowd around him" if he wasn't already posing a threat or a problem?0 -

Four, five, six police officers could not remove him without tasering him? Thats ridiculous.
It was a political atmosphere........i dont think asking some political questions was truly disturbing the peace.
They could have more peacefully removed him without a friggin doubt.0
