Judge Marilyn Hall Patel, of the U.S. District Court for the Northern District of California, has ruled to drop all charges against Charles Edward "Eddy" Lepp stemming from a 2004 raid of his Lake County, California property, on the grounds of an invalid search warrant.

Lepp told HIGH TIMES, "This motion should have been turned in the day after my arrest and it all should have been over within thirty days."

The raid netted 32,512 marijuana plants, the largest bust of its kind in the United States, with the ensuing legal battle earning Lepp the HIGH TIMES Freedom Fighter of the Year Award at the 2004 Cannabis Cup.

After starting off with powerful attorneys Dennis Roberts and then Tony Sera, Lepp eventually fired them both for refusing to file a motion using the Religious Freedom Restoration Act (RFRA) as a defense. Four months ago, the court appointed him Assistant Federal Public Defender Shawn Halbert, who immediately requested permission to resubmit all previous motions along with a motion on RFRA. Evidence of the faulty search warrant was on the top of the stack, and witnesses claim Patel took less than fifteen minutes to drop all charges.

Lepp told HIGH TIMES that the warrant used to raid "Eddy's Medicinal Gardens" had only his name, the judge's name, and the property address on it. The reason for the raid and the descriptions of the property were both glaringly missing.

Lepp still continues to face charges stemming from the February 2005 raid of nearly 7,000 indoor plants on the same property, but he remains confident, again on the grounds of procedural error. According to Lepp, the photos of outdoor plants that were used as due cause turned out to be on his neighbor's property. Also, the wiretap that provided the evidence of a sale was finally released, revealing a DEA Agent saying into the tape that Lepp had left and was heading down California Highway 20, and then counting out $2,500 dollars. No mention of a sale and no police paperwork from the day of the recording points to Lepp possessing marijuana, much less selling it.

The hearing for the 2005 raid will take place on January 9th at the San Francisco Federal Court House, with Judge Patel once again presiding.

    dont get me wrong, i fully support its legalization for any and all purposes and recognize its utility. just amused that the only posts you make are about the latest breaking development in the field :)

  • over 30,000 plants!?!! :eek: i hardly think it was just for personal use. i'm not a pot smoker although i wouldn't have strong feelings if it was to become legalised. however this dude was a major dealer of an illegal substance and should have done major jail-time.

    well if you feel that strongly about laws and rules, then you should have no problem with this case and the charges being dropped, after all, it was due to an invalid search warrant.

    It was a grow for California Compassonate Act. We are allowed to have caregivers. You see it goes like this. I go to the doctor. I have a recommendation. I can grow up to 6 plants on my own property (in some places there are ordinances against outside grow) I can also give my recommendation to someone else who has a grow. Now this person can have 6 for themselves and 6 for me..If the caregivers has 5000, clients, then it's not illegal to posess that quantity of plants. Also I argued this then and I will argue this now. To talke a figure such as 32, 500 creates an image of 32,500 full mature plants 10-15 feet high. You cant' think that many of those plants were either clones or immmature and big boyz wanted to create a statistic....


    He has done nothing that is immoral nor against the law. He has been trying to establish precedent for you and for me..Just last week he was at local Board of Supervisor meeting fighting for the local patients who are too chicken to stnad up.

    I am just glad to see that there are still judges who look for the people and not the corps, all the time. It means that he doesn't do the five life sentences...can you imagine having five life sentences? No...eddy lepp is human being; he is a man you can talk to intelligently, and his experiences make him extremely knowlegeable.

    It's not about getting high. It's a lifestyle.

    Propaganda. It's in this book, but I have read a lot of the sutff that has astounded me via articles on the internet too. I found out about the egyptian flair by simply writing the words hemps used by egyptians and found an entire page of articles.

    jackherer.com has part of his book that he has conducted a lot of research about it....i'll be back with a book from u.s. history. we search through old publications looking for hemp articles and references to find out how the gov'[t has fooled the american people..be back in an edit....with a worthwhile link....

    I'm definately no expert on drug manufacuring, but what about harder drugs from coca or opium.

    One point of view would be that the process of creating heroin or coke are actually outdated pharmaceutical ventures that became non-PC in the latter half of the 20th century. As far as legislating morality goes, it's definitely more endangering for a society to have the criminal element controlling the entire operation of the most profitable industry on the planet.

    So yeah, making plants illegal is really dumb at the end of the day and it's hard to rationalize it as anything besides a time/money wasting low point of our government's history.

    marijuana does not actually have any long term negative effects on the brain. it is quite helpful in many cases where people have issues with migraine headaches, appetite problems, sleep disorders, multiple sclerosis, and so on. it has helped me immensely to alleviate problems with migraines and the nausea and insomnia that result from the migraines. i know of many others who have benefited from its use. people also use it recreationally, and i do that as well. i don't have a problem with people smoking or consuming marijuana either way, whether it be for medicinal purposes or for recreational purposes.

    With all the other regulations and restrictions that we humans have on our lives, legalizing marijuana is but a drop in the ocean when it comes to "having the right to thrive on this planet as our ancestors did in times past".
    The only people we should try to get even with...

    I would love to know where you get your information.............There was actually a study done not to long ago that THC (the active component in marijuana) is the most benificial "drug" ever found in decreasing the plaque formation in the brain that causes Alzheimers, in turn being the most best thing we have so far in delaying the onset of Alzheimers disease. Here's one of many articles on the subject which, as apposed to your post, "These findings that cannabinoids work both to prevent inflammation and to protect the brain may set the stage for their use as a therapeutic approach for [Alzheimer's disease],".......................

    Now see, here's a case of actual injustice Marc Emery.

    That guy in the article above got off on a techincality, but he's obviously a drug dealer. 35,000+ plants is not thriving off of plants, he didn't build his house with it, he sold it to people for the purpose of intoxication. This is a massive grow op, and that is illegal.

    I smoke pot, I love it, but I think there is a big difference between personal use, or like Marc Emery selling seeds, and being a major drug dealer. Unless there is something I'm missing here, did he use his profits to benefit underpriviliged kids or something?
