    i watched an interview with Alan Derchowitz who said the constitution expressly specifies that impeachment is for sitting presidents.

    And what better way to tie up the senate than another impeachment trial while Biden tries to get his stuff through. Thanks to GA the Dems are in control however and can choose their own destiny at this point. Waiting 100 days actually makes sense to me now.

    He is probably looking at this clause and saying that the senate cannot try him because it can only try presidents.  Therefore he cannot be tried after leaving office.  I think it's a stretch.  There in no such encumberence (word?) on the House's power.  

    The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

    edit - here's the thing.  It only says that when the president is tried, the Chief Justice presides.  In theory, this clause only is saying that the Chief does not have to preside because Trump is not president, NOT that he cannot be tried.

    The problem is that most US conservatives are on board with these clowns. And they cannot stand Romney (and turn on anyone who isn't loyal to Trump).  That "reasonable conservative" we talk about exists but not in large numbers. If the primaries were to be held on January 21, a Trumplican would win. Granted, four years (well, really two years before we start the next circus again) is a long time, so I suppose there's a chance that things calm down and someone like Sasse gets the nomination.

    Mitch is smart and I think he knows that what's best for the party is to smile at all the damage they've accomplished with (and before) Trump and try to steer the party back to normal "helping rich guys." But the party voters are pretty firmly ensconced in populism at this point and if holds up, there's not much Mitch can do about it.

    I believe he still had a 40%+ approval rating and remained popular with repubs when he resigned. Nixon had pride, shame and a conscience.
    The R were a strong minority in the senate so the votes weren't there for him to stay.  It was purely a math problem for him.  I think I've read that he had no more than 15 votes to stay.
