What charges?
There is an ongoing investigation into the Clinton Foundation which may or may not lead to charges and there is a possibility on charges for lying to congress. It is not Trump's call whether these investigations get shut down or not regardless of his statement but a pardon could come from President Obama on both of these issues which would effectively block DOJ from moving forward.

People in that picture got elected and swore an oath and you are suggesting that they are inherently biased and can't do the job based on the colour of their skin.
