I think they are equal. If they couldn't tell what was going on with "metadata" then they would listen specifically to people, which I still believe they are doing after reviewing the data they do have. It is sad to me that civil rights and possibly approving of violations of them comes down to which team a person is on...can't we once all agree that Americans deserve to be treated with decency and respect by our government...no matter who they are.
I found their distinction between what happens when they say do you and would you in their questions was pretty interesting as I have never really thought about it that way.
