The cross in and of itself does not my violate civil rights. We have the right to freedom of religious expression. The fact that it is being viewed because of a state sponsored function may be considered unconstitutional under the equal protection clause of the 14th amendment and subsequent legal decisions.

Reminds me of a stat I saw recently that showed Jerry Falwell's Liberty University (a private evangelical christian school) was receiving 10x more money from the federal government than public broadcasting was.
