1. Shooting into moving vehicle (creates out-of-control vehicle/lethal safety hazard)
2. Shooting at fleeing vehicle (creates out-of-control vehicle/lethal safety hazard)
3. Officer-created danger (voluntarily stepping in front of vehicle, twice, unnecessarily)
4. Failure to retreat (no effort to step out of the way/held his ground to shoot)
5. Using deadly physical force that could not prevent the harm (bullets don't stop cars -- a particular focus of Minnesota courts).
Federal policy
Actions taken that are violations of DOJ/DHS/ICE use-of-force policies:
All five of the above, plus
6. Force used as punishment or retaliation ("F-----g bitch")
7. Failure to attempt to de-escalate
