I heard some discussion this morning that the states cannot make decisions like that without Congress. No idea if that is true or not.mrussel1 said:

i forgot about the fact that the state legislators aren't beholden to choose electors based on the vote; trump and his team are reportedly working on a contingency plan that would get republican held battleground states to appoint electors not based on the vote in those states, and it would perfectly legal under the constitution. there are 6 states that fall into this category.

Agreed. We're past the point where common decency and decorum is expected.
