Ok, in 1996, President Clinton signed the Defense Of Marriage Act (DOMA) into Federal law stating that marriag was between a man and a woman. There was no Federal Law concerning marriage prior to that, so DOMA became THE Federal statute pertaining to marriage.
The Supreme Court ruled in 2013 that PART of DOMA was unconstitutional and some states voted to allow same sex marriage. However, they were in conflict with the remaining articles of DOMA.
The way Federal Laws work is that state law can be MORE restrictive but it cannot be less restrictive than Federal law. So, some states, who voted to recognize same sex marriage were in conflict with Federal Law.
Which is the reason the Supreme Court heard the issue again this year. We all know their decision. But, what we apparently forgot is that since they can't make law, their decision to declare DOMA unconstitutional resulted in there being NO federal law concerning marriage.
Which means, jurisdiction falls to the state. And what that means boys and girls is that Kim Davis IS NOT in violation of ANY law by refusing to issue marriage licenses after the SCOTUS ruling.
In fact, if she had issued a license to a same sex couple, she would have been in violation of the state laws of Kentucky, which had voted no on the issue.
Congress failed to be prepared to handle the situation resulting from SCOTUS striking down DOMA by writing a new Federal Law so we are left with the issue being handled at a state level.
In the states that voted no on this issue, same sex marriage is not Federally protected.
Like it or not, agree with it or not, that's the way the law works in this country.

14th Amendment gf. Equal protection under the law. Has been interpreted now to include marriage equality.

Thank you for this. Not all of us who attend church look at people with bigotry and hate. You said it best when you said that you respect anyone's right to believe in God or not. I have so many wonderful friends who don't believe in God. You know what? There are times that we have some great religious discussions and we all learn great things from each other. We have mutual respect.

I would rather go forth in love and learn from each other than to go forth in hate and judgment.

Isn't that what we are here for? We discuss things. We learn from each other.

Totally agree I feel the same about the good folks that attend church every week even though I don't I respect the folks that believe as long as they are not trying to impose their beliefs on me & you never come off as one of those folks

I agree. I 100% think JAG is just fucking with us and having a blast doing it... which actually takes some dedication.
And it has kept the boards lively I suppose.... the devil's advocate serves some purpose in debate, even when it gets really ridiculous.

She is now saying she won't go against her belief, but will try to create a path that allows the issuing of the license without her name on it. So she is willing to compromise. Fair enough.

Now we will find out if those licenses will be legal. I would say, if she can't perform all the functions of her job for whatever reason, she should just step down.

Ky law rfra law allows for reasonable accomodation. The governor has thus far refused to call the general assembly to emergency session OR issued a temp exec order ( not sure this is even possible) to have the law requiring the clerks signature as the head of the office on a license suspended until the G.A meets in January. As I undrrstand it there are some bills in process but am unsure as to what they are designed for.
