Errm.. Whitesnake and All Saints (Girl group in UK) both have albums called this.. I imagine there would be a few legal issues if PJ called it that.

Do you have a source for this info? I'm sure they haven't even started writing it yet, Matt said they were going into the studio at the end of 2008...

You can't copyright titles, so there really wouldn't be a legal issue

There would be an aesthetic one however, as that's an awful name

With respect to US copyright law? Yes...

    http://www.copyright.gov/circs/circ34.html
Names, titles, and short phrases or expressions are not subject to copyright protection. Even if a name, title, or short phrase is novel or distinctive or if it lends itself to a play on words, it cannot be protected by copyright. The Copyright Office cannot register claims to exclusive rights in brief combinations of words such as:

    * Names of products or services
    * Names of businesses, organizations, or groups (including the name of a group of performers)
    * Names of pseudonyms of individuals (including pen name or stage name)
    * Titles of works
    * Catchwords, catchphrases, mottoes, slogans, or short advertising expressions
    * Mere listings of ingredients, as in recipes, labels, or formulas. When a recipe or formula is accompanied by explanation or directions, the text directions may be copyrightable, but the recipe or formula itself remains uncopyrightable.

I heard that there was a bitter argument over the title of their as of yet unfinished, but titled 9th album.

There was a 3 way tie between:

    1) Saints and Sinners
    2) Back in Black
    3) Rumors

Three band members were killed (Resevoir Dogs Style) in this heated argument.

Only Ed, Boom, and Matt survived.

    The album is stil untitled

Untrue. Stone was severely injured after shards from Jeff's upright bass pierced his left butt-cheek, but he managed to pull through.

He called me from the hospital to tell me that the name of the upcoming album is ... "SMELL THE GLOVE."

Actually no, an album title you CANNOT copyright.

Same as a book. There can be fifty different albums with the same name.

I mean where do you draw the line? Do you have any idea how many artists have a "Greatest Hits"?

It sounds silly but it's the exact same concept, so yes, a band could name their album Sgt. Pepper's Lonely Hearts Club Band if they wanted.

i think album titles fall under that category as well, like say i were to call an album Chair, Im pretty sure another band could call their album Chair, you cant copyright the word chair. like how many "greatest hits" or "best of" albums are there out there.

Maybe they should call it 'Ten II (we're still alive)' , a bit like Meat Loaf did with the whole Bat out of Hell thing...maybe MTV would suck it up and we'd have a hit on our hands :D

    You are correct.

Rumor has it the album cover will be black

Stone was qouted on the way to the hospital saying:

"It's like, 'how much more black could this be?' and the answer is none. None more black."

exactly. titles are left open. there are plenty of albums, and songs for that matter with the same title.

but yeah, the name is pretty awful for a PJ album.
    Peace, Love.
