    Yes we definitely have it a lot better than most countries, but there is much amiss in this country and we need to fix it, starting with our government. While we do have many freedoms some are slowly being eroded.

    Here is an example. One of my younger brother's friends purchased a bar right across the street to where they built the new Devils Arena in Newark. He payed top dollar for the property knowing that it would be prime location. Prior to purchasing it the city told him that he neede to do a lot of remodeling to make the exterior and interior look nice. He put in $60,000 dollars in work. Last month the city told him they where buying the property from him at the price he paid for it. He is going to fight it but they are pulling eminent domain on him and from what his lawyer told him the city will most likely win.

    So now the government has the right to make you sell your property at a price that they, not the market, determines so they can turn around and sell it to a developer for a profit.

    I'd encourage you to find out WHO THE RECIPIENTS of the appropriated properties are. In Ohio, the single largest recipient of eminent domain acquired properties is Miller Valentine Group. With that in mind, I will boycott any company that resides in a Miller Valentine development, and encourage those who value freedom, and personal property rights to do the same!

    we defintely agree this is a very shitty thing for our government to do. I'd like to know how often this happens? All I really know is the fight going on in chicago but they seem to have a worse case because its for expansion of the world's busiest airport. but a fucking strip mall in anytown USA..fuck that.

    I can see it being used for expanding an airport because that is a public works project and that is what eminent domain was created for. The problem is that the government has found a loop hole in the law and they are expoiting it for their gain at the expense of the people.

    The land used for the Prudential Center, that's the new arena for the NJ Devils here in Newark, was aquired through eminent domain. The property was then sold to developers at high premium prices. That wasn't enough though the city then jacked up property taxes in order to help pay for the arena. So not only did people have to sell their homes and property, not only did the city make a killing in the selling of property that wasn't even theirs, they also passed the bill of the arena onto the tax payers.

    Now you tell me is that a government that is looking out for the best interest of the people.

    i totally agree with you there. i feel sorry for the people mixed up in the expansion of the airport. some of them have probably lived there all their lives. to pull eminent domain on them is just evil. if they are being forced out of their homes for the sake of 'progess', at least compensate them fairly for it. i don't know how you would put a monentary value on something like that though. a fair thing to do would be to offer them the current day value of their property and then a hefty incentive on top of that. they are the ones being inconvenienced and forced out of their homes. they should be compensated for it.

    for some yes. A professional sports arena benefits many. its a fine line to be drawn somewhere. whats best for the public and whats not. obviously the people should decide. and if they cant, they should have a successful chance at challenging it.

    lets say eminent domain was decided by the people. open vote for people in the city. taken to ballot every few months or something. (just hypothetical) . many cases the person will lose only cuz many people will only see benefit from it, while loosing nothing.

    that makes perfect sense. I would almost be ok with eminent domain if people were paid a premium. then at least they have a chance to pick up and start somewhere else at the governments expense.

    The average sports arena is used how many DAYS per year? In Cincinnati, they bumped the largest produce distributor, the one that most restaurants used, to put in a football stadium. How many NFL games does a team play in a year? How many are home games? That did NOT replace the produce distributor, or the other businesses wiped out.

    If eminent domain was decided by a popular vote, that is the tyranny of the majority. Should I take your home to make a water park? No? Hey, everyone else, should we take that home to put in a really cool water park? Gee, they said "yes".

    A sports arena does benefit many and putting it to a vote would be the appropriate thing to do. The Prudential Center was put up for a vote for all of Essex county. So of course the people who lived outside of the affected area in Newark voted for it and they out numbered the people who where affected by the land grab. People who lived in their nice cushy homes in the out lying towns loved the idea of taking the land for the arena because it wasn't their property. They also didn't have to ffot the bill because the tax increase was only for the city of Newark.

    Yes, it is. It is really hard for me to get behind a program that discards individual liberty and property rights for "the greater good" especially when "the greater good" is a some sort of entertainment venue. Total bullshit. If the government give you a price that you find acceptable, great! If the government, through threat of force and coercion decides for you, bullshit!

    situations and circumstances are diffent in every case. I'm not advocating eminent domain, just having a discussion about it.
