They did sign waivers but the attorneys feel they will not hold. And they ARE gonna sue: http://www.dailynews.com/ci_5042267

interesting. at least this lawsuit and sad death will prevent this from happening again.

I don't think you should be able to sue someone else for something you did to yourself, unless you're under age or mentally incompetent. But what I think is neither here nor there, because they CAN sue, and I expect they'll win.

I dont necessarily disagree with you, but dont you think the radio station hold some responsibility ?

I'm undecided as to whether they should have some responsibility, but they definitely do, whether we think they should or not.

This is a very sad situation. It was a stupid contest, and entering it was a stupid thing to do, but I doubt anyone involved had even heard of water intoxication before. I know it was news to me. Now a woman has lost her life and a bunch of people have lost their jobs because of stupidity, and that's a shame. Most of us get away with being stupid from time to time without paying so high a price.

I would guess that from here on in, tv and radio contests that involve physical feats will have to pass by a medical professional before they're approved, and that's a very good idea. It should have been that way all along, but typically it takes a tragedy before people realize how dangerous their actions are.

  • I think that if the radio station was going to hold a contest like this, they should have made the contestants explicitly aware of the potential risk. If they had them sign a waiver, and I'm sure they did, the waiver should have outlined the risks specific to the type of activity in which the contestants were taking part...but then I guess that would take all the "fun" out of it, huh?

I think it was irresponsible on the part of the station to hold a contest like this, whether the station understood the risks or not. It's just a case of bad judgement all around...not excluding the participants in the contest. It's stupid to do something like that to your body, to basically defy nature, and not expect some kind of consequence.
  • I agree with most people that lawsuits in this country are getting out of hand.

But in this case the radio station is responsible and should be sued.

Most people don't know about over hydration, and I bet the station did not even research this because if they had they most likely would not have run the contest.

It is not like this was a dance contest or marathon, like some one mentioned in a previous post, ware death is possible however, very very unlikely. In a contest to see how much water a person can drink, over hydration and death as a result of the over hydration is very likely, especially if you don't know it can happen.

This is why the station is responsible; they had the contestants competing in a deadly contest without informing them of the possible consequences. I say this with certainty because if they had know about the dangers of over hydration, instead of laughing at this lady when she started complaining about feeling sick they would have taken her to the hospital.
    Peace through superior firepower!

People kill themselves this way...that why most psychiatric institutions have wards (locked) where there is no water, not even in the toilets. It can be quite a serious problem...people get so "drunk" on the water that they die. At work, when we first heard about this, we all looked at each other and said "Water Intoxication"...and just shook our heads...very sad...

it depends on the state laws as to whether or not waivers will hold up in court. i know in missouri you can not waive your right to hold someone or some entity responsible. a few years ago a skydiver's parachute failed to open and the guy died. he had signed a waiver but it did not hold up in court. the company was found laible and negligent and paid a large settlement.

this is truly one incident where EVERYONE involved is unbelievably irresponsible.

Seriously...what radio station in their right mind thinks it's a GOOD idea to have a contest where people drink 2 gallons of water? seriously? have they ever SEEN a gallon jug, much less two? and have they seen people's midsections...of which a tiny section of the bladder resides? they obviously bear responsibility.

As do the idiots who would enter the contest. unfortunately, 3 kids have to grow up without a mom b/c of this entire mindset.

but what's just as disturbing is the fact that the grandmother was on larry king live tonight...almost as distrubing is that kid who was held captive for 4 years on oparah.

what the hell IS going on? If one of my parents or close friends died, or was just returned from captivity, trust me...it would take me WEEKS, if not months to adjust.

these fucking whackos are making the rounds on television.

so many things are fucked up right now...
