    WASHINGTON (AP) — Lawyers for Donald Trump asked the judge overseeing the classified documents case against him to block prosecutors from using as evidence the boxes of records that FBI agents seized during a search of the former president's Florida property nearly two years ago, according to a motion unsealed Tuesday.

    The defense lawyers asserted in the motion that the August 2022 search of Mar-a-Lago in Palm Beach, Florida was unconstitutional and “illegal” and the FBI affidavit filed in justification of it was tainted by misrepresentations.

    Prosecutors with special counsel Jack Smith's office, which brought the case, rejected each of those accusations and defended the investigative approach as “measured” and “graduated.” They said the search warrant was obtained after investigators obtained surveillance video showing what they said was a concerted effort to conceal the boxes of classified documents inside the property.

    “The warrant was supported by a detailed affidavit that established probable cause and did not omit any material information. And the warrant provided ample guidance to the FBI agents who conducted the search. Trump identifies no plausible basis to suppress the fruits of that search,” prosecutors wrote.

    The defense motion was filed in February but was made public on Tuesday, along with hundreds of pages of documents from the investigation that were filed to the case docket in Florida.

    Those include a previously sealed opinion last year from the then-chief judge of the federal court in Washington, which said that Trump's lawyers, months after the FBI search of Mar-a-Lago, had turned over four additional documents with classification markings that were found in Trump's bedroom.

    That March 2023 opinion from U.S. District Judge Beryl Howell directed a former lead lawyer for Trump in the case to abide by a grand jury subpoena and to turn over materials to investigators, rejecting defense arguments that their cooperation was prohibited by attorney-client privilege and concluding that prosecutors had made a “prima facie" showing that Trump had committed a crime.

    In the newly unsealed motion, Trump's defense team asked the Florida judge overseeing the case, Aileen Cannon, to suppress audio recordings that the lawyer, M. Evan Corcoran, made of conversations with Trump. Prosecutors responded that there's no basis for excluding that evidence from the case.

    Prosecutors and defense lawyers are due back in court Wednesday for the first time since Cannon indefinitely postponed the former president's trial earlier this month. The case had been set for trial on May 20, but Cannon cited numerous issues she has yet to resolve as a basis for canceling the trial date.

    On Wednesday, Cannon was scheduled to hear arguments on a Trump request to dismiss the indictment on grounds that it fails to clearly articulate a crime and instead amounts to “a personal and political attack against President Trump” with a "litany of uncharged grievances both for public and media consumption."

    The motion is one of several that Trump's lawyers have filed to dismiss the case, some of which have already been denied.

    Trump has pleaded not guilty and denied any wrongdoing.

    WASHINGTON (AP) — Federal prosecutors on Friday asked the judge overseeing the classified documents case against Donald Trump to bar the former president from public statements that “pose a significant, imminent, and foreseeable danger to law enforcement agents” participating in the prosecution.

    The request to U.S. District Judge Aileen Cannon follows a distorted claim by Trump earlier this week that the FBI agents who searched his Mar-a-Lago estate in August 2022 were “authorized to shoot me” and were “locked & loaded ready to take me out & put my family in danger.”

    The presumptive Republican presidential nominee was referring to the disclosure in a court document that the FBI, during the search, followed a standard use-of-force policy that prohibits the use of deadly force except when the officer conducting the search has a reasonable belief that the “subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person.”

    The Justice Department policy is routine and meant to limit, rather than encourage, the use of force during searches. Prosecutors noted that the search of the Florida property was intentionally conducted when Trump and his family were out of state and was coordinated in advance with the U.S. Secret Service. No force was used.

    Prosecutors on special counsel Jack Smith's team said in court papers late Friday that Trump's statements falsely suggesting that federal agents “were complicit in a plot to assassinate him” expose law enforcement — some of whom prosecutors noted will be called as witnesses at his trial — "to the risk of threats, violence, and harassment."

    “Trump’s repeated mischaracterization of these facts in widely distributed messages as an attempt to kill him, his family, and Secret Service agents has endangered law enforcement officers involved in the investigation and prosecution of this case and threatened the integrity of these proceedings," prosecutors told Cannon, who was nominated to the bench by Trump.

    “A restriction prohibiting future similar statements does not restrict legitimate speech," they said.

    Defense lawyers have objected to the government’s motion, prosecutors said. An attorney for Trump didn’t immediately respond to a message seeking comment Friday night.

    Attorney General Merrick Garland earlier this week slammed Trump’s claim as “extremely dangerous.” Garland noted that the document Trump was referring to is a standard policy limiting the use of force that was even used in the consensual search of President Joe Biden’s home as part of an investigation into the Democrat’s handling of classified documents.

    Trump campaign spokesman Steven Cheung said in a statement Friday that Biden and "his hacks and thugs are obsessed with trying to deprive President Trump and all American voters of their First Amendment rights.

    “Repeated attempts to silence President Trump during the presidential campaign are blatant attempts to interfere in the election. They are last ditch efforts of desperate Democrat radicals running a losing campaign for a failed president,” Cheung said.

    Trump faces dozens of felony counts accusing him of illegally hoarding at his Mar-a-Lago estate in Palm Beach, Florida, classified documents that he took with him after he left the White House in 2021, and then obstructing the FBI’s efforts to get them back. He has pleaded not guilty and denied wrongdoing.

    It's one of four criminal cases Trump is confronting as he seeks to reclaim the White House, but outside of the ongoing New York hush money prosecution, it’s not clear that any of the other three will reach trial before the election.

    Trump has already had restrictions placed on his speech in two of the other cases over incendiary comments officials say threaten the integrity of the prosecutions.

    In the New York case, Trump has been fined and threatened with jail time for repeatedly violating a gag order that bars him from making public statements about witnesses, jurors and some others connected to the matter.

    He's also subject to a gag order in his federal criminal election interference case in Washington. That order limits what he can say about witnesses, lawyers in the case and court staff, though an appeals court freed him to speak about special counsel Smith, who brought the case.

     Judge rejects request to restrict Trump’s speech on FBI, says motion was faulty

    U.S. District Judge Aileen M. Cannon on Tuesday denied a request from federal prosecutors that she order Donald Trump to stop making incendiary claims about law enforcement personnel, saying the government should have more thoroughly consulted with Trump’s attorneys before coming to her.
    The judge, who is overseeing Trump’s classified documents criminal case in Florida, strongly rebuked special counsel Jack Smith, who submitted his motion after the former president and his political campaign issued statements that said, “Biden’s DOJ was authorized to shoot me!”
    Those comments exposed FBI agents involved in the case “to the risk of threats, violence, and harassment,” Smith said in the filing.
    Cannon said the emergency request lacked “professional courtesy” and crammed important facts about the request in an “editorialized footnote.” She denied the motion “without prejudice,” which means prosecutors could raise the issue again in the future, presumably in a manner that would address Cannon’s concerns.

    A fleeting question Supreme Court Justice Clarence Thomas posed to Donald Trump’s lawyer during oral arguments in the Trump immunity case in late April may have been a harbinger.
    “Did you, in this litigation, challenge the appointment of special counsel?” Thomas asked.
    The question seemed odd, given that Thomas would have been familiar with the issues before the court — issues that didn’t include the legality of special counsel Jack Smith’s appointment. Justices ask questions for a variety of reasons, but some read this one as Thomas’s volunteering a potential argument for the Trump team, which was claiming that the former president had immunity from prosecution in the Jan. 6 case involving efforts to overturn the 2020 election.
    Fast-forward a bit more than a month, and the issue Thomas broached is suddenly being treated seriously and extraordinarily by U.S. District Judge Aileen M. Cannon in the other case Smith has brought, which involves Trump’s alleged mishandling of classified documents and obstructing efforts to retrieve them. She previously scheduled a hearing on the subject for June 21, and she signaled Tuesday that it would be a substantial hearing featuring outside experts making arguments. That’s a rare occurrence.
