    The problem with the 14th Amendment actions against Trump is that is up to Congress to enforce the 14th amendment. 

    Do you think Congress is going to enforce this amendment before the next general election?

    But that's besides the point. I was referring originally to the polls. Trump is only gaining in popularity since this indictment and 14th amendment blizzard  began. The strategy is clearly not working. I'd pick another.

    Since when does Congress enforce any amendment?

    This is not a political strategy. This is about the Constitution and whether POOTWH is eligible to be on a state ballot for POTUS. SCOTUS and/or the courts will decide whether the 14A sec 3 applies. Not Congress. Unless they want to try and amend the constitution to clarify what eligibility criteria should apply. But two thirds of the states would have to ratify whatever they came out with.

    where is trump getting stronger other than with republicans? where?

    trump lost the popular vote by 7 million votes last time. his base is dying off, the youth strongly despise him, and he is not getting new voters. he has to win states to get electoral votes, and he is not flipping any biden states at this point. polls are useless 11 months before the election.

    I am pointing out the strategy is clearly not working. The “checking” of presidential power has always been with the voters. It has never been trusted in full to the courts.
    The checking of presidential power is part of congress’s job and is literally written into the Constitution.

    Three judges on the U.S. Court of Appeals for the D.C. Circuit heard unprecedented arguments Tuesday morning on whether the U.S. Constitution makes former presidents immune from criminal prosecution.
    A U.S. District Court judge has already rejected Trump’s argument, which ultimately is likely to be weighed by the U.S. Supreme Court.
    Federal prosecutors working for special counsel Jack Smith have charged former president Donald Trump with four counts related to conspiring to obstruct the 2020 election results.
    Trump’s team has argued that the federal election obstruction case in D.C. should be dismissed, saying he was president at the time of the actions laid out in the indictment. His lawyers have also argued that prosecuting him would constitute double jeopardy, since he was already impeached and acquitted by Congress for his actions related to the Jan. 6, 2021, attack on the U.S. Capitol.
