    WASHINGTON (AP) — Former Supreme Court Justice Sandra Day O’Connor, an unwavering voice of moderate conservatism and the first woman to serve on the nation’s highest court, has died. She was 93.

    The court says she died in Phoenix on Friday, of complications related to advanced dementia and a respiratory illness.

    In 2018, she announced that she had been diagnosed with “the beginning stages of dementia, probably Alzheimer’s disease.” Her husband, John O’Connor, died of complications of Alzheimer’s in 2009.

    O’Connor’s nomination in 1981 by President Ronald Reagan and subsequent confirmation by the Senate ended 191 years of male exclusivity on the high court. A native of Arizona who grew up on her family’s sprawling ranch, O’Connor wasted little time building a reputation as a hard worker who wielded considerable political clout on the nine-member court.

    The granddaughter of a pioneer who traveled west from Vermont and founded the family ranch some three decades before Arizona became a state, O’Connor had a tenacious, independent spirit that came naturally. As a child growing up in the remote outback, she learned early to ride horses, round up cattle and drive trucks and tractors.

    “I didn’t do all the things the boys did,” she said in a 1981 Time magazine interview, “but I fixed windmills and repaired fences.”

    On the bench, her influence could best be seen, and her legal thinking most closely scrutinized, in the court’s rulings on abortion, perhaps the most contentious and divisive issue the justices faced. O’Connor balked at letting states outlaw most abortions, refusing in 1989 to join four other justices who were ready to reverse the landmark 1973 Roe v. Wade decision that said women have a constitutional right to abortion.

    Then, in 1992, she helped forge and lead a five-justice majority that reaffirmed the core holding of the 1973 ruling. “Some of us as individuals find abortion offensive to our most basic principles of morality, but that can’t control our decision," O’Connor said in court, reading a summary of the decision in Planned Parenthood v. Casey. “Our obligation is to define the liberty of all, not to mandate our own moral code.”

    Thirty years after that decision, a more conservative court did overturn Roe and Casey, and the opinion was written by the man who took her high court seat, Justice Samuel Alito. He joined the court upon O’Connor’s retirement in 2006, chosen by President George W. Bush.

    In 2000, O’Connor was part of the 5-4 majority that effectively resolved the disputed 2000 presidential election in favor of Bush, over Democrat Al Gore.

    O’Connor was regarded with great fondness by many of her colleagues. When she retired, Justice Clarence Thomas, a consistent conservative, called her “an outstanding colleague, civil in dissent and gracious when in the majority.”

    She could, nonetheless, express her views tartly. In one of her final actions as a justice, a dissent to a 5-4 ruling to allow local governments to condemn and seize personal property to allow private developers to build shopping plazas, office buildings and other facilities, she warned the majority had unwisely ceded yet more power to the powerful. “The specter of condemnation hangs over all property,” O’Connor wrote. “Nothing is to prevent the state from replacing ... any home with a shopping mall, or any farm with a factory.”

    O’Connor, whom commentators had once called the nation’s most powerful woman, remained the court’s only woman until 1993, when, much to O’Connor’s delight and relief, President Bill Clinton nominated Justice Ruth Bader Ginsburg. The current court includes a record four women.

    WASHINGTON (AP) — The Supreme Court on Wednesday said it will hear an appeal that could upend hundreds of charges stemming from the Capitol riot, including against former President Donald Trump.

    The justices will review a charge of obstruction of an official proceeding that has been brought against more than 300 people. The charge refers to the disruption of Congress' certification of Joe Biden's 2020 presidential election victory over Trump.

    That's among four counts brought against Trump in special counsel Jack Smith's case that accuses the 2024 Republican presidential primary front-runner of conspiring to overturn the results of his election loss. Trump is also charged with conspiracy to obstruct an official proceeding.

    The court's decision to weigh in on the obstruction charge could threaten the start of Trump's trial, currently scheduled for March 4. The justices separately are considering whether to rule quickly on Trump's claim that he can't be prosecuted for actions taken within his role as president. A federal judge already has rejected that argument.

    A lawyer for Trump didn’t immediately return a message seeking comment on the Supreme Court’s decision to review the charge.

    The Supreme Court will hear arguments in March or April, with a decision expected by early summer.

    The obstruction charge, which carries up to 20 years behind bars, is among the most widely used felony charges brought in the massive federal prosecution following the deadly insurrection on Jan. 6, 2021, when a mob of Trump supporters stormed the Capitol in a bid to keep Biden, a Democrat, from taking the White House.

    At least 152 people have been convicted at trial or pleaded guilty to obstructing an official proceeding, and at least 108 of them have been sentenced, according to an Associated Press review of court records.

    A lower court judge had dismissed the charge against Joseph Fischer, a former Pennsylvania police officer, and two other defendants, ruling it didn’t cover their conduct. The justices agreed to hear the appeal filed by lawyers for Fischer, who is facing a seven-count indictment for his actions on Jan. 6, including the obstruction charge.

    The other defendants are Edward Jacob Lang, of New York’s Hudson Valley, and Garret Miller, who has since pleaded guilty to other charges and was sentenced to 38 months in prison. Miller, who’s from the Dallas area, could still face prosecution on the obstruction charge.

    U.S. District Judge Carl Nichols found that prosecutors stretched the law beyond its scope to inappropriately apply it in these cases. Nichols ruled that a defendant must have taken “some action with respect to a document, record or other object” to obstruct an official proceeding under the law.

    The Justice Department challenged that ruling, and the appeals court in Washington agreed with prosecutors in April that Nichols’ interpretation of the law was too limited.

    Other defendants, including Trump, are separately challenging the use of the charge.

    Defense attorney Kira Anne West, who has represented several Jan. 6 defendants charged with obstruction of an official proceeding, said the courts will have to “undo a whole bunch of cases” and adjust many sentences if the Supreme Court rules in their favor.

    “This is a watershed day,” she said. “In our world — defense lawyer world — this is huge.”

    West represents a man scheduled to be tried in early January on charges including the obstruction count. She doesn’t yet know if she will seek a delay until the Supreme Court resolves the challenge.

    More than 1,200 people have been charged with federal crimes stemming from the riot, and more than 700 defendants have pleaded guilty.

    there was a story about a letter thomas wrote back in 2000.  Saying he didnt make enough money and he might have to resign his seat to earn up to his potential in the private sector.  Resign during the Clinton admin........

      Roberts sidesteps Supreme Court’s ethics controversies in yearly report

    The Supreme Court will be tested in the coming weeks to untangle politically consequential legal questions with the potential to reshape the 2024 presidential election. The court’s reputation remains marred by ethics controversies involving lavish travel and gifts, and public approval ratings remain low following high court rulings to overturn long-standing precedent.
    But Chief Justice John G. Roberts Jr. did not address any of those contemporary issues Sunday in his annual “Year-End Report on the Federal Judiciary.” Instead, he looked back on technological advancements in the nation’s court system, detailing developments from the quill pens used by justices in the 19th century to electronic databases of the 1980s to online trial proceedings prompted by the coronavirus pandemic.
    Roberts, a history buff, also expounded on the potential for artificial intelligence to both enhance and detract from the work of judges, lawyers and litigants. For those who cannot afford a lawyer, he noted, AI could increase access to justice.
    “AI obviously has great potential to dramatically increase access to key information for lawyers and non-lawyers alike. But just as it risks invading privacy interests and dehumanizing the law,” Roberts wrote, “machines cannot fully replace key actors in court.”
    Public approval of the Supreme Court remains at historically low levels, reflecting a dip that followed its 2022 decision to overturn Roe v. Wade and eliminate the nationwide right to abortion. The court has also faced immense public pressure and criticism following news reports that some justices accepted, but did not disclose, luxury travel funded by billionaire friends.

    it appears trump has asked the supreme court to overrule the colorado ballot decision.

    i thought this had to go through other courts first?

    maga is claiming this will be a slam dunk 9-0 decision allowing him back on the ballot. i am not so sure.
