    DeSantis 2024 prospects prompt Fla. lawmakers to review law

    MIAMI (AP) — Florida Gov. Ron DeSantis may need some help from the state Legislature if he proceeds with a highly anticipated bid for the Republican presidential nomination.

    A “resign to run” law requires state officeholders to commit to leave their positions if they run for federal office. The measure, which has been on and off the books over the past several decades, was reinstated in 2018. But Republican leaders in the GOP-dominated Legislature have expressed openness to changing or rescinding the law when they gather again in March.

    Florida House Speaker Paul Renner recently told reporters that it was a “great idea” to review the law. Senate President Kathleen Passidomo similarly said that changes to the resignation requirement would be a “good idea.”

    “If an individual who is a Florida governor is running for president, I think he should be allowed to do it,” she said.

    DeSantis is emerging as an early favorite of some Republican donors and activists who are seeking a conservative leader without the baggage associated with former President Donald Trump, who has already announced his 2024 White House bid. In an underwhelming year for Republicans in much of the U.S., many in the party are taking notice of DeSantis' commanding reelection victory, including his strong performance in longtime Democratic strongholds around Miami.

    The governor has dodged questions about his presidential aspirations, telling reporters last month to “chill out” about the subject. But during a debate before the November election, he pointedly declined to answer questions about whether he would serve out his full term. And he's gained notice for his travel around the country on behalf of other GOP candidates and will release an autobiography next year.

    Florida constitutional experts said there's little ambiguity in the law, likely requiring some type of action by the Legislature.

    “There is no ambiguity, no debate, no dispute,” said Bob Jarvis, a professor at Nova Southeastern University’s law school. “Under current law, DeSantis cannot run for president before first resigning as a governor.”

    But given the Republican majorities in the Legislature, the law isn't expected to pose a significant hurdle. The governor didn't respond to a request for comment about whether he's calling for a change.

    There is precedent for changes to the Florida law to help clear a path for potential candidates for higher office. In 2007, the Republican-controlled Legislature changed the law to prevent problems for then-Gov. Charlie Crist, who was being considered as a possible running mate for Republican John McCain in 2008. Crist later became a Democrat and challenged DeSantis for reelection this year.

    “You can make the argument that there is no reason to have this law. The voters all knew that there was a chance that (DeSantis) would not complete his term as governor and that he was at the very least considering a presidential run,” Jarvis said. “No voter could say I was duped into voting for someone.”

    Only a handful of states have similar resign-to-run laws. Some say that while the law is clear about politicians having to resign if they seek federal office, it is vague about when they would need to do so. It states the resignation must be submitted at least 10 days before the first day of qualifying for the office.

    “There is too much ambiguity,” said Jon McGowan, an attorney that specializes in business and state government law, adding that it is not clear if a candidate would be qualified when he runs for the Republican nomination or for the general election. McGowan says the motivation behind the law “is really about not having endless elections.”

    “What we’ll see is they will create a new section so that candidates for president or vice president do not have to resign to run, and just if they win.”

    A revision to the law is likely just one piece of a legislative agenda DeSantis would like to oversee next year as a launching pad to a presidential campaign. DeSantis calls his administration and election results a “blueprint” for Republican success.

    Education and abortion bills are likely to be filed. Incoming Republican state legislative leaders have referred to a new law limiting instruction on sexual orientation and gender identity in early grade school that DeSantis championed, hinting that additional similar legislation could follow.

    Ex-Miami US Rep. David Rivera arrested in Venezuela probe

    WASHINGTON (AP) — A former Miami congressman who signed a $50 million consulting contract with Venezuela’s socialist government was arrested Monday on charges of money laundering and representing a foreign government without registering.

    David Rivera, a Republican who served from 2011 to 2013, was arrested at Atlanta’s airport, said Marlene Rodriguez, a spokesperson for the U.S. Attorney's Office in Miami. The eight-count indictment alleges he was part of a conspiracy to lobby on behalf of Venezuela to improve U.S.-Venezuela relations, resolve an oil company legal dispute and end U.S. economic sanctions against the South American nation — without registering as a foreign agent.

    The indictment cites meetings in Washington, New York and elsewhere that Rivera is described as setting up with senators, congressmen and White House officials, none of whom are named.

    In July 2017, for example, the indictment alleges Rivera wrote in text messages to an unnamed U.S. senator, “Remember, US should facilitate, not just support, a negotiated solution," and, “No vengeance, reconciliation.”

    Pressure has been building on Rivera for more than two years after it emerged that he received the massive contract from a U.S. affiliate of Venezuela’s state-owned oil company as President Nicolas Maduro was trying to curry favor with the White House in the early days of the Trump administration.

    Rivera’s Interamerican Consulting was sued in 2020 by PDV USA — a Delaware-based affiliate of Venezuelan-owned Citgo — alleging the former congressman performed no work as part of the contract he signed in 2017 for three months of “strategic consulting” meant to build bridges with key U.S. stakeholders.

    In the indictment, prosecutors say that in October 2017 Rivera sent a text message acknowledging he should register to lobby for the Venezuelan government, otherwise “my attorney has told me is currently illegal ... and not to touch it with a 50-foot pole, but it would be a scandal of monumental proportions.”

    Although Rivera’s contract was with a U.S. entity, any work he performed on behalf of Maduro’s government or Venezuelan business interests required him to register as a foreign lobbyist.

    Rivera, 57, has maintained his innocence and has countersued PDV USA, alleging breach of contract and unjust enrichment for its failure to pay $30 million he says he is still owed. A lawyer for Rivera said he had not seen the indictment and Rivera did not immediately respond to an email seeking comment.

    The U.S. Marshals Service said Rivera bailed out of jail Monday afternoon after making an initial appearance in Atlanta federal court.

    Around the time Rivera was hired, Maduro’s government was seeking to court Donald Trump's administration, donating $500,000 to his inaugural committee through Citgo and initially avoiding outright criticism of the new U.S. president who had a penchant for befriending strongmen including Russia's Vladimir Putin and North Korea's Kim Jong-un.

    The charm offensive ultimately failed, as Trump in 2019 recognized opposition lawmaker Juan Guaido as Venezuela's legitimate leader and imposed stiff oil sanctions on the OPEC nation in a bid to unseat Maduro.

    Records that emerged as part of the ongoing lawsuit show Rivera’s consulting work was closely coordinated with Raul Gorrin — a Venezuelan insider and media tycoon who has been sanctioned and indicted in the U.S. on money laundering charges.

    Correspondence introduced as part of the lawsuit shows Rivera and Gorrin discussing buying “concert tickets” — a possible code word for bribes — to unnamed officials and attempting to coordinate a meeting between Venezuela’s foreign minister and executives from the U.S. oil company Exxon.

    As part of that effort, they also roped in Republican Rep. Pete Sessions, whose former Dallas district was home to Exxon and who secretly traveled to Venezuela in 2018 to meet with Maduro.

    Some of the $15 million in payments that Rivera received as part of the contract were transferred to two of his associates and a Miami company, Interglobal Yacht Management, which PDV USA alleges was used to pay for maintenance on one of Gorrin’s superyachts.

    To justify the large payments, PDV USA allegedly created “phony contracts” backdated to March 20, 2017 — the day before the consulting agreement took effect.

    Rivera's contract had all the hallmarks of a sham, according to PDV USA, which since 2019 has been run by directors appointed by the U.S.-backed opposition.

    According to the lawsuit, Rivera’s Interamerican made just $9,500 in the year before being picked, out of the blue, by Maduro loyalists without any due diligence. Rivera never met in person with anyone from Citgo or PDV USA while supposedly working on its behalf. Instead, he filed two “deficient and incoherent” progress reports of the seven he was required to submit.

    “The written record is bereft of any evidence that Interamerican performed any of the contracted services,” PDV USA argues in court filings. “There is not a single email, a single PowerPoint presentation, a single outline, a single memorandum, a single calendar entry, or anything else suggesting that Interamerican ever performed any of the services.”

    Before being elected to Congress, Rivera was a high-ranking Florida legislator, serving from 2003 to 2010 in the House. During that time he shared a Tallahassee home with current U.S. Sen. Marco Rubio, who eventually became Florida House speaker.

    Rivera has been embroiled in several election-related controversies, including orchestrating the stealth funding of an unknown Democratic candidate to take on his main rival in a South Florida congressional race and a state investigation into whether he hid a $1 million contract with a gambling company. That probe also involved possible misuse of campaign funds to pay for state House activities already reimbursed by the state.

    Republican leaders have announced their intention to read the Constitution on the House floor during the first day of the new Congress. That’s all well and good, but they need to understand it as well.
    Unfortunately, Republicans have shown a troubling lack of comprehension of our founding document in recent years. So here’s some assistance with some sections that seem to trip them up.
    Let’s start with Article II, Section 1, Clause 7: “The President shall, at stated Times, receive for his Services, a Compensation, which shall neither be encreased nor diminished during the Period for which he shall have been elected, and he shall not receive within that Period any other Emolument from the United States, or any of them.”
    This provision should have prevented former president Donald Trump from reaping income from foreigners, including foreign government officials who stayed at his properties. Yet Republicans chose to ignore it.
    This is particularly important now, as Forbes recently revealed that Trump failed to disclose that he had a loan with Daewoo, a South Korean conglomerate, while running for president in 2016. Forbes reports, “There’s little doubt that if the world had known about the debt while Trump was president, it would have sparked conflicts-of-interest concerns, perhaps heightened by Daewoo’s historical ties to North Korea. (In the mid-1990s, the firm was the only South Korean company permitted to operate a business inside the country.)” Perhaps Republicans might want to pass legislation prohibiting any president from continuing to do business with foreigners while in office? Just a thought.
    Next up is Article II, Section 1, Clause 8: “Before he enter on the Execution of his Office, [the president] shall take the following Oath or Affirmation: I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.” Enough said, right?
    Here’s another critical one: Article II, Section 4. “The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.”
    Inciting an insurrection, refusing to come to the aid of Congress and the vice president during an attack on the U.S. Capitol, cooking up a scheme to throw out electors, and extorting Ukraine for political favors all meet the definition of “high Crimes and Misdemeanors.” Again, Republicans seemed not to care.
    Let’s skip over to Article III, Section 2, Clause 2: “In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.”
    This should serve as a warning to Republicans and the partisan right-wing hacks they put on the Supreme Court. Should Democrats win back the House and keep the Senate and White House in 2024, they can alter (even abolish!) the Supreme Court’s appellate jurisdiction. They could reasonably argue that a court that operates like a partisan body, not a judicial one, shouldn’t be reviewing the decisions of lower courts.
    Presumably, Republicans will include in their reading the amendments to the Constitution. The First Amendment reads: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
    Note that it does not say “Twitter shall make no law.” Nor that “publishers can reject no book.” The notion, as many on the right suggest, that it is unconstitutional for private companies to refuse to serve as a platform for misinformation or noxious views is nonsense.
    It’s also worth calling attention to the “establishment of religion” clause. The framers might be shocked to learn that, according to the right-wing Supreme Court, this doesn’t prohibit organized prayer at school events, government funding of religious schools and the imposition of health-care decisions based on sectarian views.
    Republicans should also mull over the 14th Amendment: “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”
    That doesn’t divide Americans into “real Americans” and “elites,” as Republicans so often do. No individual or group is entitled to maintain a grip on power, no matter what Christian nationalists say.
    Let’s end on one of my personal favorites, Section 3 of the 14th Amendment: “No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who … shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”
