    So is Lance Mercer able to legally market that photo on merch since he owns the copyright as long as they don't  use the words Pearl Jam?

    Photographers were most likely commissioned and granted approval for the usage of those in the shots (event photography, press portraits, etc). If you sold your own photos, you'd still need copyright claims.

    Yes, the photographer owns the rights to licence its use. This was recently brought up in the whole Kendal/Kylie Jenner use of a tupac photo on their shirts. It was the photographer who sued, not the estate of pac. I like the hang time shirt, just don't like white t-shirts. Also don't like brands pasted all over the top.
