A New Mexico man is alleging abuse after authorities conducted three enemas, a colonoscopy, an X-ray and several cavity searches on him simply because he appeared to clench his buttocks.
David Eckert's attorney recently filed a federal lawsuit on his behalf over the Jan. 3 incident, in which police and doctors co-opted an "unethical," 14-hour series of cavity searches, KOB-4 reports.
Court documents state that Eckert was driving out of Wal-Mart in Deming when he failed to fully stop at a parking lot stop sign. He was immediately pulled over.

When he stepped out of his vehicle, an officer reported that he appeared to be clenching his buttocks. That fact was cited as probable cause to suspect that Eckert was hiding narcotics in his anal cavity. Officers obtained a search warrant and Eckert's humiliating examination began at a nearby medical center.

    • Doctors penetrated Eckert’s anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
    • Doctors penetrated Eckert’s anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
    • Doctors then X-rayed Eckert again; no narcotics were found.
    • Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert’s anus, rectum, colon, and large intestines. No narcotics were found.
Eckert's attorney told the Herald-Sun that the case needed to go public because it could set a scary precedent.

"If the officers in Hidalgo County and the City of Deming are seeking warrants for anal cavity searches based on how they’re standing and the warrant allows doctors at the 'Gila Hospital of Horrors' to go in and do enemas and colonoscopies without consent, then anyone can be seized," Shannon Kennedy said.

Deming Police Chief Brandon Gigante argued that his officers "follow the law in every aspect." Kennedy said that the officers' warrant allowing them to search Eckert expired hours before his ordeal was over, and the warrant wasn't even valid in the county where the procedures were performed.

Eckert is suing the City of Deming, Deming police officers Bobby Orosco, Robert Chavez, Officer Hernandez, and Hidalgo County deputies David Arredondo, Robert Rodriguez and Patrick Green. He's also suing Deputy District Attorney Daniel Dougherty and the Gila Regional Medical Center.



Wait a minute you mean to tell me this ALL started because did not fully stop at a parking lot stop sign. Only in America, I hope he gets every penny for this ordeal. One good thing it didn't happen here in Florida.

    No drugs were found by police or doctors at the Gila Regional Medical Center in Silver City, N.M. The exhaustive search began when Eckert allegedly rolled through a stop sign in Deming, N.M., on Jan. 2, 2013.
    Albuquerque civil rights attorney Shannon Kennedy is representing Eckert and says she is seeking "in excess of $1 million in punitive damages alone" from the law enforcement and medical personnel responsible and their employers.

    The apparent justification for the search, Kennedy said, was that police believed Eckert's buttocks were clenched during the traffic stop.
    But, she said, it's also possible the officers just didn't like how her client looks.
    "Maybe the officers who did this don't like him living in their community," said Kennedy. "He's a white boy, a scraggly white boy, and all these officers are Hispanic. It's a New Mexico thing."

    Kennedy said her client, 63-years-old when he was detained, looks somewhat like rocker Tom Petty and says he denies standing with his buttocks clenched.


    In the search warrant affidavit that sought permission for an anal cavity probe, one police officer said he asked Eckert for permission to physically search him after the minor traffic stop. When Eckert refused, the document says, a police K-9 dog alerted them to the side of his car. Kennedy alleges the dog is not certified to search for drugs and may actually be a pet.

    A judge granted the search warrant for the anal cavity probe, but not necessarily a colonoscopy.

    Officers then transported Eckert to the Gila Regional Medical Center after an emergency room doctor at a Deming, N.M., hospital told them "this is unethical," Kennedy said. The doctor who refused to comply with police is willing to testify if the lawsuit goes to trial, according to Kennedy.

    After arriving at the Gila facility, doctors examined Eckert's anal cavity twice with their fingers, put him through an x-ray scan and then inserted three rounds of enemas into his anus. After each enema, doctors examined the stool sample produced. Eckert was then given a second x-ray scan and forced to undergo a colonoscopy with anesthesia.

    It's unclear why the colonoscopy was necessary after enemas and x-rays did not reveal hidden drugs. Eckert was sent a $6,000 bill for the medical procedures he involuntarily underwent, his lawyer says.

    This strikes me as similar to painting all Muslims, Christians, choose any political party, on and on, with the same stupid brush.

    The other thing I wonder is why does the wonderful animal called pig get attached to something some people hate? Pigs are very cool animals. I befriended a mean assed boar named Wendell one time. Wendell was as mean-spirited an animal as I had ever seen. I started with reaching over the fence with a stick and scratching his back. Eventually it was hand over fence scratching back. One day I hopped the fence and walked right up to Wendell and patted his big fat back good and hard with several times with the palm of my palm and we we friends for life.

    Maybe just go talk to a good street cop sometime, Unsung. You might lose some of that hatred. Or maybe you just want to cling to it.

    I have always assumed the term pig as it relates to cops came from the stereotype of the fat, doughnut eating cop. Whether that is true or not I do not know.

    in this context, the term pigs seems to be aptly used.

    there is no projection of the term to every police officer in the world, nor is the speaker saying it to the police officer's face.

    also, the context speaks to the particular police officers who in the story, behaved in such a way that a derogatory term applied to them is certainly conceivable.

    also, the context speaks to the particulars of the story, i.e. the clenched buttocks, so the "trying not to shit himself" part is implying humor, to which the term "pigs" is more in line with this humorous context than would the plain term "police officer".

    the hospital is the biggest sham here ... they acted like some salesperson who got a rich client walking in ... they basically, did all that stuff because they saw $$$ ... like so many hospitals now ... always pushing the solution that is most profitable ... ya, the cops are pricks but the hospital is whom i'm more pissed at ...

    they're called police officers, some good some bad and some are just tired of the dirt bag's they have to deal with everyday, I have run across a few that use their gun and badge to pull stupid shit but I have also met quite a few that are stand up guy's, this "pig" thing sounds like for some that it just a way of saying "I'm a rebel" ...how cool is that ?

    but back to topic...I have a feeling that that this guy has pryors and is well known by local police officers...but if not he's in for some huge cash and rightly so....speaking of clenching butt cheeks...gotta go. :mrgreen:

    This comment should have ended this thread. The lack of respect for an honourable profession is becoming disturbing, but I'm beyond being surprised at people on these forums.

    The treatment of this individual is shocking to say the least, but with that said:

    Byrnzie, recently you have felt compelled to come to the defence of Muslims and Islam from the assaults they repeatedly face on these forums. You- correctly I might add- attack people for their condemnation of a group of people for generalizations made in response to the actions of extremists. Yet, here you are promoting the labels 'pigs' and 'the filth'. And you mock others for paying respect to a profession that places themselves at risk for shit pay.

    How do you feel comfortable admonishing Godfather for his generalizations regarding Muslims, but feel free to offer your generalizations for the police?

    I would suggest that you do not pick your spots with regards to whom you exercise objectivity.

    As for the rest of the kooks, when attacking a profession, please list yours prior so we might consider the source. If your profession is beyond reproach, then fair enough.

    Of course not all police officers are bad.

    However, there are also no shortage of stories, such as this, where abuse of power is repulsive.

    I can't think of what other profession there is that grants such opportunities for abuse of power. Well....except for the priesthood. I suppose there's also blue collar crimes.

    I don't want to be attacked for being anti-police, because I'm not.

    But how can one argue that abuse of power in the police force doesn't exist?

    What is the solution? I don't know.

    One thing for sure, I would never want to be a police officer because it's so damn dangerous.

    I suppose maybe because of the inherent danger, also comes the adrenalin or whatever else that leads to abuse of power, and that these incidences must be endured by society as a trade off for having people that stand and take these positions in the first place.

    These statements would be worthwhile for some to consider.

    Most of the people bashing cops would never do the job themselves... and expect the job to be done for pesos. Beggars can't be choosers: if you want a top notch police force... then make it a priority and pay very well- recruiting people into the profession instead of merely accepting 'reasonable' candidates. What type of doctors do you think we would have if we paid them $35,000 a year?

    Imagine how much police work is done on a daily basis. Now place these stories in perspective: they are not the norm and far from regular. It's one thing to pay these people that do so much good so little... it's quite another to incessantly bash the entire profession every time the opportunity presents itself.

    It is quite remarkable anybody wants to do the job given the lack of respect shown towards it.
