dont really understand the whole "did he rape rape her" or not controversy. No one under the age of 13 can give consent. So even if she said "yes" to him and gave consent it means nothing of course. I mean wasnt he 44 when it happened? And she 13? He was in control of the situation, not her. It was rape.0

whoopi suggested it wasnt rape, because "she was aware and her family was aware". I dont know how the family could know about the rape, and even if they condoned it, how does that make it okay. And secondly, I am sure the girl was aware of what was going on, so yeah she was aware. But still, the fact remains, a 13 year old cant give consent. Plain and simple.
I dont know what his punishment should be. I dont know about statute of limitations. I dont know, how the jury should deal with the fact that the girl now woman who was raped forgives him and believes he shouldnt be punished.
I do know that what I talked about above is the law and stone cold facts.0 -

The thing to remember though is the statutes of limitations and juries don't really come into play in this case. They guy pled guilty, but skipped the country before the judge could hand out his sentence. It is basically the same as if he had broken out of prison the day he got there. My understanding is that all there is left to do is for a new judge to choose a sentence to give him. If they did some how give him a new trial I am not sure how that would work, since he admitted to what he did in court.0 -

The concept of getting a bunch of filmmakers to back him up is pretty funny. I have an idea... I'm going to get a bunch of friends who are amatuer photographers and musicians like me to sign a petition saying I'm a good driver, and if I ever get pulled over for speeding, I'll show it to the officer.
