Have any buyers backed-out of deals?...if so, what is the most realistic recourse against them?
What do buyers have to pay up-front in order for work to commence?
backing out happens all the time NOW A DAYS.... BEFORE CONTRACT....but if it happens in the middle of the job alot of people get fucked out of alot of money... but once that contract is signed... its a go... as for the $$$ to start the build its i wanna say its aroung 20%-30%
Maybe someone around here can explain this release date crap to me. Why is it that retailers will have a CD sitting in their back room for days before a "release date" and not be allowed to put it on the shelves? Why does the Ten Club, the official merchandise store of Pearl Jam, have to wait to ship them closer to the release date when it was stated LAST WEEK that they were all packed up and ready to ship? They are probably losing potential sales as the leak becomes more and more widespread. Seems like a decent amount of artists have been moving up release dates once their albums leak.
These are legitimate questions that hopefully someone can answer for me. It's really quite silly that we aren't allowed to talk about an album that is sitting in the backrooms of every target and sitting in the 10 club warehouse. If you don't want it to be downloaded illegally, just release the thing.
They ship CDs to stores in advance to ensure that every store has the chance to sell them on the release date. It wouldn't be fair for one store to have the ability to sell it sooner then another....too much chance for favoritism, etc.
Makes sense however...in this situation there is online 1 retail store involved. And even in the other cases with non-store exclusive releases, i'm sure they would be able to send a memo to every retailer saying go ahead and sell it wouldn't they?
I'll bet you wont be able to buy it there tomorrow anymore. I'm sure they have already received a phone call and a fax!
NEVER!!!! they are part of the CIMS group ...http://www.cimsmusic.com/ same as EASY STREET... last time i checked eddie likes indie stores........
PLUS the owner and a few other workers went out for the easy street show ..they got invited ....that concert was for friends and CIMS owners..... he has pictures/setlist from the show all over the store... he also told me last year that this year might be the year.... has always has a TON of big acts there... he has been trying to get pearl jam to stop by for a night but to no avail.... OZZY/STAINED/METALICA/INCUBUS/GODSMACK/ have all been there just to name a few..... Stained played a mini concert on the roof top for about 5,000 people FOR FREE

Might be part of the deal they worked out with Target? They said they picked them over Best Buy because Target was willing to share with the little guys and BB wasn't.

Speed of Sound album version grows on you... trust me.
I don't see how you find Amongst the Waves, No Codish.. its their most epic song since Ten.. Give it another listen.
I totally agree about Speed of Sound. I loved the demo and thought that anything added to it might be overdone cause it worked well as an acoustic ballad. But I much prefer the album version now that I've heard it.
but I don't think I'd call Amongst The Waves "epic" by any means (though it's a good tune). I mean, if Rearviewmirror or Immortality ever heard you call Amongst The Waves "their most epic song since Ten", they'd probably come to your house and kick your ass.

I didn't like the album version of Speed of Sound at all the first dozen times I played it.. now its getting better than the demo.. I wish the band didn't mess with us and make us fall in love with the demo first.. messing us up..
By epic, I mean Amongst the Waves builds.. the guitar solo sounds like Mike is playing from on top of a mountain.. that's what I consider epic. Ed's vocals are way up there. Its a classic Pearl Jam song. Best described as a Given to Fly/Hold On hybrid if you ask me.
There seems to be a lot of negativity towards Force of Nature. It is one of the few songs I have had a listen to and I absolutely love it! I totally agree with the rave reviews Amongst the Waves and songs like The End and Just Breathe are getting, but Force of Nature in my opinion is an amazing song!
Can't wait to hear it all! 2 days left here in Australia!

I looked at this entire thread but didn't see anything, have you accessed the "vault" yet? Any cool online content?
i didnt even try it !!!!! HOLLEY SHIT but then again its NOT from target...hold on ill drop it in my PC
Are the target one's enhanced? I don't think they will be. I think it will be visit a website, download a special component that accesses your CD drive and recognises the disc in there. I don't think there'll be any PC executable stuff on the CD, but I could be wrong. I suppose they have a ton of room on there, since it's "only" 36 minutes long.
I'm aware of what you're supposed to be able to access, I was wondering about the online content and how it worked to download the two concerts. Also, was wondering if you could access it or if you had to wait until the 20th.
tryed the CD in my pc....... its a cool interactive CDROM.... but no downloads..... it has the cover of the cd you scroll over each picture and leads you to a link on the pearl jam home page.... there is a link for CONCERT DOWNLOADS ... but i takes me to the 2008 shows and i have to buy them ... NO FREE SHOWS FOR ME

Force of Nature is great, totally agree! Nice little solo at the end to, nothing overly complicated but it works.
Amongst the Waves makes me think that someone in the band's been listening to a bit of Carbon Leaf (specifically Learn to Fly).
I hear alot of another artist with a song called Learn to Fly, Tom Petty. There are several chord changes and various sounds that remind me so much of Petty and the HB's. I think they crossed some of same paths Petty crossed early on, with the bit of new wave creepin in.

I reallllly like Unthought Known too.
After that I would say Got Some, then Amongst The Waves.
Then come the two Into the Wild tracks Just Breathe and The End.
Got The Fixer after that
Next is Johnny Guitar
Gonna See My Friend
Supersonic
Speed of Sound
