Alright, so after reading all of this mess and going to the gym and thinking about it, here is my 2 cents on what has most likely happened here:

When the contract was worked out between Pearl Jam and Live Nation for the venue, Live Nation included a clause where existing season ticket holders got to keep their premium seats. As a result, Live Nation would issue 10C their allotment of tickets day of the show, at the number agreed to in the contract.

What has happened is that Live Nation didn't make a clause for any new Season Ticket sales in the contract. I would say this is what usually happens, and in the time period leading up to the show Live Nation gets a limited number of people calling in for new season tickets. I would say it's usually limited, so Live Nation taking an extra 10 or 15 seats right up front probably goes completely unnoticed by most bands, because their still getting their allotment of the tickets (or their cut of the sales).

So I think what has happened here is that Sawyer coming onto the forums and bragging about his ticket score brought this to the attention of 10C who have reacted justly, and are probably technically in the right, as Sawyer wasn't an existing season ticket hold when the contracts were all signed. So he has no one to blame for this clusterfuck but himself. Chances are if he hadn't of screamed about it here, 10C would have been none the wiser and Live Nation would have got away with cheating their own contracts, like usual. 10C still would have got its set number of tickets fine and dandy, just with an extra row or 2 in front.

So essentially this is the Live Nation's fault; however (and I hate to defend Live Nation, but right now it's going to happen), 10C should have been professional enough to let Live Nation deal with their mess first, and then post this information on the board. Usually in a situation like this you give someone some professional curtosy, however, we all know how 10C and Pearl Jam feel about LN/TM, so this wasn't afforded.

And let's be honest here, 10C's beef isn't over an extra row of seats between fan club members and the stage, it's about lost revenue. They could be the ones controlling the sale of these seats and making the money off them, not Live Nation, and that's what is driving this whole issue.

Just my 2 cents, don't shoot the messenger. I will bet though that Sawyer will now wind up with better seats than anyone in the venue.
Houston, Texas... Believe it or not, there are 7 million people here... must be a couple of fans who'd love to see you play.

If you weren't in the 10club and were just some random dude that bought those tix from Live Nation I dont think you would be blaming 10club for what happened. They had nothing to do with your transaction for tix.

i think the opposite .10c did well cos let know sawyer and anyone else that already bought those ticketrs before 10c presales and livenation presales..now they have the option to buy 10c tickets and dont pay so much money for something the seller didnt have to sell in the first place

How are you getting screwed? As of now, you haven't lost out on anything yet and if LN gets you your money back, there's no damage done. You can still buy VIP tickets they just won't be as close as LN promised you. No 10club tickets have been sold yet, you can still go that route. Why should 10club have to rectify anything? LN promised you something that they can't deliver on. It's not like tickets are sold out already, you still have time to get tickets.

I understand being frustrated at how this played out but why do you think the deserve to be compensated with something out of this mix up?

and 10c didntpromised ypou 6th row tickets and didnt sell them so expensive..i really think that isnt that you dont understand..you dont WANT to understand

But that's the thing, they wouldn't have been double sold...

what makes you think Live Nation gave 10C all the seats? I highly doubt that, especially seeming how Tim says in his post that you will be seated behind the 10C seats...

Live nation gives 10C the tickets. Not like "contractually" gives, I mean they physically issue them the tickets. So when they printed out 10C's tickets, they just would have bumped their seats back another row to accommodate tickets that they had sold, done and done!

I can't understand why you expect 10C to rectify this. You purposely tried to go around their ticketing philosophy by making this purchase with live nation. You essentially flipped them the bird and said, "Fuck your policies I will not sit on the lawn and share the seats with my fellow 10 clubbers."

Why the fuck should they help you at all?

It really does suck for Sawyer. But LN was at fault not 10c. Make sure you get refunded and move onto the Monday presale. To say this as nice as possible 10c don't owe you anything
  • josevolutionjosevolution Posts: 30,739
they should have never been available for purchase because 10 Club said, sorry, these are ours.

But don't you think the rep at LN should of stated that to you on the day you made the transaction, the only way Tim or anyone at 10C would of been able to stop you from that transaction would of been if they knew ahead of time that you were planning on that route , you came here after the fact ...

    Sawyer,

Ya we paid more than $2700 for the VIP box seats
  • SawyerSawyer Posts: 2,411
a direct quote from the rep..interesting...this was early on in the e mail process:

"Yes, for 3 shows if you choose Alpine only and it is per seat.
I only have 4 seats left.

I do not have any knowledge of what holds or seats the Fan Club is using. I know my season seat holds and that is the extent of it."

so if he has HOLDS he must still have these? lawsuit waiting to happen

This is a little harsh, no? There will be plenty of avenues to purchase tickets outside of being in the Ten Club, and he thought he found one. I agree that it doesn't seem the Ten Club erred, but it's unfair to intimate he's thumbing his nose at anyone. Anyone who thought they were getting awesome seats and has that much money tied up in them would be really frustrated right now.
