This lawsiut is a absurd. It makes no mention of anyones civil rights being violated,and what was Obama saying the whole time ? That Families were going to be stopped for the color of their skin while they were going out for ice cream. :roll:

Supremacy- No one is disputing that the feds broadly get to set immigration policy. Arizona is not setting immigration policy and It does not conflict with U.S. law. So the supremacy issue really is not an issue at all.

As widely anticipated, Attorney General Eric Holder today filed a lawsuit against Arizona and Gov. Jan Brewer over the state’s immigration law. The suit seeks a preliminary injunction to stop the law from being implemented.

The court filing states that Arizona law is pre-empted by federal law and therefore violates the supremacy clause of the U.S. Constitution.

The filing makes no assertion that the law is discriminatory or risks being applied in a discriminatory fashion, as the president and other officials said they feared would be the case. Interestingly, this suit makes no civil rights charges against the Arizona law.

“The State of Arizona has crossed this constitutional line,” write Assistant Attorney General Tony West, United States Attorney Dennis K. Burke and others. “In acknowledged disagreement with the manner in which the federal government has regulated immigration and in contravention of these constitutional principles…The states are not permitted to set their own independent immigration policies, with varying and potentially conflicting enforcement systems and priorities. Were a number of states to act as Arizona has and strike out on their own, federal immigration policy and enforcement efforts would be crippled.”

The suit states that the Arizona law pursues only the goal of “attrition” while ignoring other objectives Congress has established for the federal immigration system.

UPDATE: Senate Minority Leader Mitch McConnell, R-Kentucky, released a statement saying: “Suing the people of Arizona for attempting to do a job the federal government has utterly failed to execute will not help secure our borders. If the President wants to make real progress on this issue, he can do so by taking amnesty off the table and focus his efforts on border and interior security. It is long past time for this administration to prioritize solving a crisis over imposing an agenda and the first step is to recognize that attorneys and amnesty are not acceptable alternatives to border security and job creation.”

Gov. Brewer, meanwhile, is soliciting donations to help defend the state from the Justice Department lawsuit, tweeting: "We will be very aggressive in defending our law. Donate to help keep AZ safe.”

    The federal government doesnt want states to make up their own immigration laws so we end up with a mishmash of laws regarding entry in the country. It makes sense if you think about it for two seconds from a non partisan view. But whatever, what did these idiot law makers think was going to happen passing this racist ass law? Bunch of idiots.

    BTW where was Mitchy boy at when Bush was trying to get immigration reform done? Amnesty was Bushes idea. Mitch is a bought and paid for senate whore, like most of them, and clearly is just trying to score cheap political points by blaming Obama. Like there aren't enough fucking fires to deal with right now, now the fact there are a bunch of racists ass law makers in power, it's Obamas fault. Pathetic.... The Empire is falling, can't wait until it all comes crashing down.

    No one is arguing that the federal gov and congress gets to set immigration policy. Arizona is simply enforcing it. If it's such a racist bill then why doesn't the brief make any such argument? Also federal law says that they the Feds don't even have to have a reason to ask someone if they are here legally or not. So I guess the federal law must be racist to then huh?
    As far as M.Mconell goes I don't know what his stance was then. This lawsuit is a waste of time. Obama should be focused on creating jobs not suing the state of Arizona. Besides I thought he said he and his administration weren't going to rest until Americans were working again,then again he says that everytime he speaks.

    If they were simply enforcing an existing law then they wouldn't have had to make their own law, would they?

    Because it's not necessary to make that argument. You don't argue (and shouldn't waste your time arguing) the merits of a law that shouldn't have been made to begin with. Once it's established that they had no right to make any law, the content of the law is irrelevant. The question of whether or not Arizona is allowed to make immigration law trumps the question of whether or not the law is racist.

    Oh yeah the PATRIOT Act how could I have forgotten that? Didn't Bush get a standing ovation from the Democrats during one SOTU speech when he mentioned that parts of the PATRIOT Act were about to expire?

    I had such Hopes!!!, i feel so used. first time i ever voted in my life, what a fuckin waste of my time.

    he also sent 30,000 more troops to afganistan, over 100 American's died last month, i think i read were up to 70 so far month.

    Doesn't AZ already have a couple state laws related to immigration? And weren't they unsuccessfully challenged as unconstitutional when they were first enacted? I would be really suprised if this case had any legs.
