Mike McCready T Shirt Design
Hey all, just put up my first T Shirt design atempt! I will be donating 50% of any profit to a charity of my choice (assuming I actually sell any that is :oops: ). Would love some feedback! Used a picture I took in Dusseldorf in '07.

Why wouldn't it be? It's not like I've used a copyrighted picture, it was a photo I personally took in Dusseldorf. Can't see any difference between this and people selling actual photos/copies of photos on ebay and other places

B)I don't think you can use MMc's name or Pearl Jam to help sell the shirt, as in the description of the shirt
I don't have a problem with it. I'm surprised it's still here. It doesn't really seem legal.
a) - being the artist me.
b) - fair point hadn't realised that will have to change it - hmm or is it? Thinking about it, I don't think it is when describing something. How else would an artist/photographer market their images if not by accurately describing them. If I were to sell any images I had taken at a gig to, for example a magazine, I would sell them by describing the images as being of 'x' band featuring 'x' guitarist or 'x' singer. In this case Pearl Jam featuring guitarist Mike McCready. It's an accurate description and not a use of any trademarks or copyrights on the actual item being sold. It's not like I'm saying it's a Pearl Jam or Mike McCready endorsed item.
Any other opinions on this?

If it just said "McCready - Legend"...there wouldn't be an issue, but if you're using someone else's image to turn any sort of profit, does that fall into the copyright infringement realm.
I honestly don't know...again, just adding my 2¢.

Yeah I think it is maybe a bit of a grey area as I was always under the impression that unless a contract was signed then the copyright of any image lay with the photographer (unless the image was taken in a 'private' situation - even then it's a bit grey, just look at all the paparazzi images of celebs in 'private' situations that end up in papers/magazines to make a commercial gain), but I could be wrong.
Anyhoo I've passed it on to 10c for clarification so we will find out soon enough. If it's not ok, no items will be sold!

Just thinking out loud, but can you actually copyright your likeness? If it was possible I would imagine every celeb would do it to legally stop any unwanted pictures of them appearing in the press.

i do believe if you are out in public, your picture may be taken and used for your own purposes. this is why fine art photographers can do street portraits, hang and sell them in galleries, etc, without consent from the subject in the photo. also why celebrity rags can get away with all the pics they put in their publications.
honestly, i don't understand why everyone is giving strummers a hard time? (not meaning you, PBM, it's the all-inclusive 'you' :P) is it b/c it's a photo? photos are art too. as i've already mentioned, chiqui designed another beautiful pearl jam t, is selling it at her site....and all anyone offered was praise. (rightly so b/c it's beautiful) as far as i know, 100% of her profits are going to her, the artist, and again...tis her perogative. no one *needs* to be giving proceeds to charity to be able to sell stuff here. people resell posters all the time at a profit here! so here strummers is giving 50% profits to a charity, and she still gets a ahrd time....i don't get it....... :?

Nice rant, but who is giving her a hard time? I simply asked if it was legal to profit on a shirt by using MMc's name and image, and PJ's name to sell it.

Have done some research myself over the past day or so and apparently (after trawling through loads of 'law speak') there are 2 different copyright laws for image use, one for commercial use (i.e tshirts,posters, advertising etc) whereby you need a 'model release' from anyone in said picture and one for editorial use (e.g rags with celebs, papers etc) whereby you don't need a 'model release' for publication. Even though, ultimately, there is a commercial gain in both instances.
So for this example, as Mike was recognisable (i.e it was his likeness) I couldn't use that image on a tshirt I have for sale, however on the other tshirt design (from a completely different band btw) you can't recognise anyone (it just looks like 2 generic people in a band: http://www.zazzle.co.uk/black_and_white ... 7649634617 ) therefore that is ok.

Thanks for the kind words Decides :P , but it's ok - I didn't see it as being given a hard time. To be honest I'n glad people brought it up so I could find out more info. I just assumed there was one copyright law for everything, but it turns out the one I thought covered everything just covered editorial use.
