    outcome of their mediation:

Accordingly, it is Ordered that the <pearljamlive.com> domain name NOT be TRANSFERRED from Respondent (the fan) to Complainant (pearl jam).

enforcement band?? no I just think it would be stupid if they didn't take action. and a big misconception of pearl jam is that they could careless about their own property..

but pearljamlive.com was not their property. and they weren't making a claim about the music, since that's something they've allowed to be done for a long time - trading of music in a free way. from the info on there it sounded like they had talked with the fan about licensing that website... but probably thought it would be cheaper just to own it outright. if someone is cybersquatting on a legitimate .com (like owning www.bandname.com) that's one thing, but this was different. pj sat on the sidelines during the Napster thing... but I'm surprised they went to bat on this one.

    D. Respondent’s Supplemental Submission

    Respondent further asserts that:

    (a) Complainant’s management sent Respondent emails praising Respondent’s website.

    (b) The Parties entered into settlement negotiations, part of which involved an offer by Complainant to license Respondent’s use of the Domain Name.

i could see why 10C chose to pursue the pearljamlive.com domain name, seeing as how back in '04 they were already planning to introduce digital downloads of the band's bootlegs and obviously what better domain name than pearljamlive.com to do that from - guess the next best choice available to the 10C back then was pearljambootlegs.com ;)

not that it applies in the case of pearljamlive.com, but it would be very foolish for an individual to go up against PJ/10C's lawyers by infringing on registered trademarks
