Anyone familiar with Bankruptcy?

Apparently my soon to be ex husband is going this route... Things are still in both of our names (house included)and I'm just wondering how this will all effect me. I'll be seeing a lawyer soon, but in the mean time I was hoping for some insight.

    Yeah... I don't wanna be familiar with it either... But he's made up his mind it seems. Apparently his rehab counselor has done it and recommends it for him...UGH!

    Definitely go see a lawyer. From what I understand (and it is very little), but bankruptcy is sometimes a viable option for some people, but most of the time, it's not worth it. And if your name is still tied to everything, I would think it would affect you. Sorry I don't know more!

    Make sure you get a good lawyer. I don't know much of anything about bankruptcy. I did a bit of bankruptcy work over the summer, but it was corporate bankruptcy. Still, I imagine what he does could have some effect on you, so you should get a lawyer that specializes in that. Don't go to someone that has every kind of law imaginable listed on his website or commercial. You want to make sure he knows what he's doing and can make sure your ass is covered so your credit doesn't go down the tubes with him.

    It might be good for you though. If he's in way over his head and can get some creditors off his back you can both probably breathe easier.

    This is what he keeps saying, but I have no reason to trust anything he says anymore. And I'm quite pissed he keeps throwing in the fact that if he files he can get a different job that helps him stay sober. I may seem heartless, but it just seemed like a pity plea to me.

    If it's a struggle for him to stay clean at his current job, then switching to a job where he can is also better for you. Addiction wreaks havoc on one's finances. Anything he can do to keep his shit together is good for you, as I assume he's paying you some sort of support (otherwise, why would you care where he works?).

    effect - is an actual result



    as to bankrupcy, no atual experience...but i too strongly suggest consulting a lawyer, see where you stand since you still have joint property, so good luck!

    He will be paying some support, but I really don't care where he works (it was his way of extracting pity from me and it used to work). I don't want him to use again. But I also want to be able to get a student loan and finish school. He's thinking of himself and I need to think of myself. It all boils down to the fact that we can't sell our home, and if we did it wouldn't sell for what we bought it for... Leaving us having to pay in the end.

    I guess I'm more pissed at his approach... Saying things like 'oh its not too bad, you'll get credit card offers a year later and it'll be like it never happened'
    Fuck that, I'm trying to rebuild my life and credit from his fucked up ways any how... Now throw this on top of it.

    Yup. I also get annoyed that nobody seems to understand when you use the word 'ensure' as opposed to 'insure.' I even read judicial opinions by supposedly highly intelligent and educated scholars... and they fuck it up!

    actually, no english major here, nor google.....but i was an art teacher for a decade, and for whatever reason, regardless of subject...if one is a techer, you are expected to know 'everything'...at least according to my students. :p but sure, i have an interest in the language, tho my atrocious typing here might seem to prove otherwise. :lol:

    when my parents were divorced they both had to file for bankruptcy.

    They basically had 0 credit for 7 years....

    so all your debt is forgiven, but your credit score ends up being just like it was when you were 18.

    you are lucky. i sell mortgages and look at credit reports every day. if you're name was on all the same stuff as him, i could pretty much guarantee it would have ended up on your credit report and damaged your scores. now you could have fought it and had it removed. but that is a pain in the ass. and nowadays, if you have a bk on your report, a lot of lenders wont touch you for at least 2 years.
