OK, so the other day, I got hit from behind. No one was hurt, minor damage to my bumper ($500+ estimate). The guy that hit me has no damage to his car.

Since it was a minor fender bender, we exchanged info and I went home and called my insurance co. I then went and made a police report. After that I called HIS insurance co. to file a claim.

Fastforward to this week and lo and behold....his insurance is refusing to pay. Why? Because the guy who hit me is now claiming that HE was hit from behind and catapulted into me!!!!! I did not see any other car involved at the time of the accident.

So now I have to file a claim with MY insurance who will battle with his insurance over this. In the mean time, I have to pay for the repairs until this is all settled!

To this I say BULLSHIT!!!!!!!!!!!!

If you fricken are at fault, pay the damn bill. Asshole who hit me!!! I am so mad!

Well hind sight is 20-20. Ask for a copy of the police report involving the third car. If it doesnt exist, than you might be on to something.

That does suck. I've been in a similar situation before. However my insurance paid for everything to get fixed and then went after the other company on their own time to get the money. What kind of insurance do you have? I have state farm, and they took care of it even with their bogus claim.

This reminds me of the time I was rear ended in my old work truck though. This girl drove her civic under my bumper and nothing happened to my truck but she was all freaked, but I told her to take me out to dinner and I'll call it an even deal. I wasn't going to even turn it in anyway, but I got a nice dinner out of it. :p

Funny I have state farm as well and they did the same for me.
But I thought that might be because I live in a no fault state.

I agree...always get an officer out to the accident. It's much harder for the insurance company to refuse to pay for damages when their client is found to be at fault.
  • It's not the insurance companies, it's the stupid fucking drivers that suck.

I was rear ended in the fall by a kid that just bought a new car and didn't have insurance.

Your insurance company will pay for it and they will go after his insurance company. You should not have filed a claim with HIS insurance company. Thats not how it works.

You file a claim with your insurance company, and they pay you for the damage. If its the other guy's fault, they go after his insurance company to reimburse them.

Also, it helps if theres a police report.

That is what MY insurance co told me to do.

    1. Make the police report.
    2. Call his insurance and file a claim against him.
    3. Get an estimate on damage.

My insurance co wont be paying anything really. I have a $500 deductable and the cost will be between $500 - 600 to fix. I'm screwed! I hate irresponsible people! Even if I get reimbursed later, I don't fricken have $500 to fix this damn car.

    I fricken hate people!

If you made the Police Report - it should mention there was no 3rd car. Make sure you tell his insurnace there was no third car. Also call the police and say he is making a false report regarding the accident and there being a third car. As well as if he was hit from behind in a 3 car accident and pushed into you, there would be damage to the rear of his car, even if there was none in the front.

    Good question

The deer couldn't respond or get up....plus no wallet

I did see the Buck laughing as if he had just gotten a Life Insurance policy on her

Should have followed the buck until he went to cash in the policy and then shot it ;)
