Candidate for a Darwin Award?

I attended a Health and Safety training course today.Apparently I could be personally liable for up to £25000 and up to two years in prison if an employee was to have an accident and make a claim.
One of the examples the lecturer gave of a upheld claim was that a teacher was showing visitors around a school.The gym hall had a trap door in it.When they entered the hall the trap door was open.The teacher highlighted the use of the trap door for theatre productions the school often put on.But she didn't close the door and continued to chat to the visitors while walking around the gym hall.She stepped back and fell through the still open trap door.I have to confess I giggled much to the annoyance of everyone else in the room.I was told off by the lecturer who stated the teacher broke both legs in the fall,was of work 9 months but then sued the school and was awarded £40000.
When does personal responsibility come into knowing a trap door was open but to continue a tour without closing it.Was she just stupid or did she have the right to claim?
