So I went back to Krogers about a month ago trying to get my old job back. I'd been away at college and came back cause I got in some pretty big debt. So I applied and come in for an interview and they said they didn't really need to interview me cause they knew me and the lady who did the schedualing was out for that day and they would presonaly call me in a few days (cause I came in on a late Friday afternoon) So a week roles by....no answer. So I call up and they say "Just give us some time and we'll take care of it."

Another week roles by and I go in and to make a long story short I go in 4 times and I was very calm and patient. So I wanted to know why they weren't calling me. So I said to myself "Whether they re-hire me or not I will show up here everyday until I get an answer."

So I go in for trip #5 today and the hiring manager says "We cannot rehire you at this store because your file states Non-rehireable."

So I ask I can't come back here at all? What does it say?

The Lady says It doesn't say anything, it just says non-rehireable. So I said "Well is there anyone I can talk to or call to find out why?" And she said No there isn't.

So right away my brain says "Disabled Ohioan.....Discrimination." So I leave and I call up the American Association of People With Disabilities. http://www.aapd.com They tell me they don't get involved in personal cases, they're more on the national level.

So they tell me to call the Equal Employment Opportunity Commission. So instead of that I call Krogers Human Resources Department and explain the situation. I tell them that they refuse to tell me why I am not rehireable so the lady I spoke with tells me she will get back with me and I ask her for her name and number. So 30 minutes later I get a call asking for me to come back to the store.

So the lady who 30 minutes ago said there was no way they would hire me back says "You shouldn't have called HR cause you got me in trouble. But come in for an interview on Friday." I was pissed that she said " You shouldn't have called HR you got me in trouble" But I kept my mouth shut.

First I thought "Who the hell else was I supposed to call?"

Second: "How am I responsible for getting you in trouble when I'm looking out for myself."

Third: "Do you think I'm really that dumb to just walk away and not to question the reasons why I can't come back here?"

Then I thought of George Carlin when he said "The owners of this country don't want that. They don't want a population of citizens capable of criticle thinking. They don't want well informed well educated people capable of criticle thinking. That doesn't help them. What they want are "Obidiant Workers" People who are just smart enough to run the machines and do the paper work and just dumb enough to passivley accept the low paying shitter jobs with the reduced pension and reduced benefits."

Here's the youtube thing of it.

Why did you think that the only reason you were labeled "not rehirable" is because of your disability? What did anyone do or say, if anything, to lead you to believe that?

I get really sick of people screaming discrimination when they're fired from or not hired for jobs. Get over it. Maybe they just didn't think you were good enough for the job, aside from your disability.

  • I'm sorry but I do take offense to that. There have been many times within the workforce and outside it where I have been discriminated against. Disabled Americans are among the smallest minority in America.

In answer two your second question, I'm a lot friendly smarter and curtious to customers than any of those rubes over there.

I don't care if you take offense to it.

I just fail to see how you can claim discrimination without any proof.

  • They never said why, but maybe its because of what George Carlin said "They don't want people capable of criticle thinking. They want obidiant workers!!!

I never said they did, but as I've had a history of this in the work force I'm apt to thinking this first. Besides they always bitched at me that my ELMS score was the lowest which is a timer htat times how fast you can check out customers.

No, but when they classify someone as "non-rehireable", and they refuse to give explanations, that someone has every right to be suspicious and to call HR. Kudos for standing up for yourself, OP!

Did you quit without advanced notice. The only time I was ever listed as not rehirable was when I was working in retail management back in college. I quit to take a better position and did not give the required two week notice. Other than that I had done an exemplary job. So, while it would be a horrible offense it they listed you as "not rehirable" due to a disability, could there be any other reason that you can think of for being listed that way? I believe Kroegers is a supermarket. Supermarket/Retail positions are usually decent jobs with bullshit rules that don't allow room for critcial thinking and expect you to be an "Obediant employee". Once you realize this the easier life will become.

HR, maybe, but it doesn't sound like it qualifies as an issue for AAPD or Equal Employment Opportunity Commission.

You're completely missing my point, which doesn't surprise me.

Listen. There is a difference in defending yourself, and then jumping to unnecessary conclusions and making false accusations.

The part I take issue with isn't him calling HR, but automatically thinking its a case of discrimination when he doesn't know that at all.

exactly. you had no idea of the real reason they didn't want to rehire you. I don't know about your particular store, but I shopped at a kroger for years and they had a very diverse staff with many people with disabilities. and why would being from ohio get you discriminated against?

You should alsways be in contact with HR anyway. I think you had a right to find out why you were "non rehirable" but you should not have blamed anyone for discrimination without knowing the facts. I hope you didn't mention discrimination when you made the phone call to HR. that would not have been a good way to anything accomplished. You were lucky you got to have an interview out of it, but now that woman you got in trouble is going to make your life hell if you work there.

did you expect "critical thinking" to be part of your job at a supermarket? what was your job there? Do you do/say things that you may have though of as "critical thinking" but that may have been seen negatively in a job where no critical thinking is required?

Don't knock the underground think tanks that supermarkets across the country hold sacred! Who else would come up with $.69/lb for Bananas wherever you shop?!?

What I want to know is why you feel it necessary to be a real ASS to someone who was asking for advice?? Some of you people on this board need to get off your high horse and quit acting like you are fucking RIGHT about everything!!

agreed. also, maybe he would not have had to think discrimanation right away, if they had just given him a straight answer. most people who discrimanate dont come out and tell you that they are doing so. so maybe thats where he got the idea that it was happening to him/her.

if so, why didnt they say that? it's HIS file, he has a right to know what's in it and why certain decisions were made.

personally malcolm, i wish this had happened to you 2-3 years in the future after i had passed the ohio bar so you and i could both retire by 2010.

where did he say he automatically thought it was discrimination? i didnt see that anywhere. what i saw was that to the best of his knowledge he had always been a good employee. he had been told he didn't have to interview and that he could have a job. then suddenly that was reversed and no explanation was given. since he could find no reason for this decision and they refused to give him one, it hardly seems problematic that he wondered if his disability played a role in it. even then, he didn't file a lawsuit or anything. he contacted their HR department to ask what was going on. it's not like he hired me to sue them into bankruptcy, and he probably could have.

hahaha I just meant that like, sometimes when you are working in a particular capacity, you are not expected to think and just do. it doesn't sound like his job at kroeger was one that required a lot of thinking because he worked there when he was very young. I'm saying that he might have been viewed as "difficult" or something.

and I agree with soulsinging that they should have REASONS written there, not just nonrehirable, and if they don't, then it should be void and they should be made to consider hiring!

BUT here's a BIG thing I don't get about this story, Malcom. Why did you expect discrimination if they hired you before? You had the same disability, and it sounds like you worked there for a while. Why would they hire you before but not now based on your disability??? AND ALSO...if you think it was all about discrimination, then why did you post about the owners not wanting critical thinkers? I think you know the reason you were non-rehirable, and you know it wasn't discrimination.

I don't think they technically would have to show it to him, and I also don't think they have to give a reason for not rehiring him.

but their unwillingness to do so after telling him he had a job and didn't even have to apply is certainly enough to raise one's suspicion about just why they changed their mind.

Well sure, but that still doesn't make it discrimination. And if he goes around accusing them of that with absolutely no proof, he could be sued for defamation of character... technically.
