US Supreme Court allows UDV consumption of DMT

This is from Dec. 2004, but I found it interesting....

Members of respondent church (UDV) receive communion by drinking
hoasca, a tea brewed from plants unique to the Amazon Rainforest
that contains DMT, a hallucinogen regulated under Schedule I of the Controlled Substances Act, see 21 U. S. C. §812(c), Schedule I(c). After U. S. Customs inspectors seized a hoasca shipment to the American UDV and threatened prosecution, the UDV filed this suit for declaratory and injunctive relief, alleging, inter alia, that applying
the Controlled Substances Act to the UDV’s sacramental hoasca use violates RFRA.

The ruling is that UDV can consume a Schedule I drug under the Religious Freedom Restoration Act of 1993 (RFRA).

    I've only done it once myself, and it was pretty crazy to say the least.

    I saw a B. Caapi root in a "smart drug" shop in Amsterdam earlier this year.
    Made me think about it all the more.

    Some day i'll try it again.

    Maybe grow some phalaris grass or something.

    It seems that way for some people. While for others it's denied.

    There was a group called The Church of the Universe who attempted to legally smoke pot saying it's a religious right. But they've been repeatedly denied. Apparently in order to have religious beliefs you must have a history in ancient times. Dumb.

    Me. too.

    But I'm not UDV or whatever. I think it's dumb, you can do whatever you want if you believe it's part of your religion, which is a spiritual thing. But if you just want to do something for spiritual grounds then you may be restricted by law, since it's not a religion with ancient roots.

  • hmm...I wonder if someone in USA wants to sacrifice a human claiming that he is a follower of an ancient religion (I think Aztecs were doing that, but I may be wrong), what would the US courts do since you say it must be a religion with ancient roots :)

    I might do that. I don't have cannibalist roots, but I'm sure I could come up with something. I'll be like that guy in Germany that ate that other guy that wanted to be eaten. Damn, I can't remember his name.

  • Can you believe that he was only sentenced to 8,5 years in prison main reason cannibalism not being in German laws and the victim's willingness to be killed and eaten!!!

    I met a reverend from that sect. Still have his business card. He had some tasty candy treats. Smelled like grape hubba bubba...

    I can't really argue that sentencing. Clearly both participants were mentally ill and both were willing.
