Belmont, CA Bans Smoking in Homes

This is the most obsurd city ordinance I have ever heard of. It is completely uninforcable and never mind that it is probably unconstitutional.

    The ban is only for apartment buildings, multi-family homes, etc., but wouldn't that decision be up to the landlord. My landlord does not want anyone smoking in the building or the apartments. So I abide by his rule, but now if my landlord said it was OK for me to smoke in my aprtment who the fuck is the government to overrule that.

  • I think cigarette companies will eventually be forced to create a fully synthetic "neutral" smelling type of cigarette which has had nicotine artificially added to keep it addictive. Some kind of ridiculously processed tobacco will be used (like it isn't already though). In removing the cigarettes smell, it will make them slightly more hazardous to your health.

    and people will still buy and smoke them I bet.

    Let's say you live in an apartment... and you (or your wife... or your kid) has asthema... and it gets hot in the Summer... so you keep your window open.
    The guy that lives below you smokes... like a 3 pack a day habit... he also leaves his window open.
    You go down to talk about his smoking and he gives you the, "It's my rights" speech and is a real dick and smoke more... just to piss you off.

    It's his right... yes. But, are his rights to smoke violating your rights to breathe? I think if people want to smoke.. fine. but, just because they smoke, doesn'rt mean you have the breathe it in, too... right?

    It's his right... yes. But, are his rights to smoke violating your rights to breathe? I think if people want to smoke.. fine. but, just because they smoke, doesn'rt mean you have the breathe it in, too... right?



    I can see where you are coming from but even with this ordinance you can smoke outside in a common area, now if that common area is outside infront or in the back(or courtyard) the smoke can still get in an open window. Still that guy you speak of is an ass and has no concern for anyone else. Now, if myself or wife, kid has asthema I would close the windows and put on the AC or a humidifier.

    Oh and I am a smoker and I can see both sides of the argument. But non smokers(not all) have a stick up there crack. I was in a bar/rest one night and I lit up. This lady from a few tables away came over and asked(but more like told) me to put it out and that she doesn't care for the smell. I said thats to bad maybe you shouldn't have sat in the smoking section. She crawled back to her table after that(I put it out when I was done). Back in the day when I could smoke in places like that I was pretty curtious about it. I wouldn't smoke if people around me at other tables where eating dinner or if there wasn't a smoking section(but you can still smoke).

    I know... I smoke on occasion (usually alcohol or anxieity is a factor). But, I usually wander off to a place by myself or out where all of the smokers are. So, I know what you are saying.
    And I know the Anti-smoking Nazis are out there... I have seen them. Including one girl that was in the smoker's patio at a local bar... complaining about all the smoke. I told her it was like going to a bar and complaining about the drunk people there.
    I can see both sides... and it's not an easy call.
